They may need to be modified depending on the facts of the case.<\/p>\n<p>If the plaintiff alleges that the defendant assisted in the wrongful conduct, modify question 1 as in element 2 of\u00a0CACI No. 3100.<\/p>\n<p>If specificity is not required, users do not have to itemize all the damages listed in question 4 and do not have to categorize \u201ceconomic\u201d and \u201cnoneconomic\u201d damages, especially if it is not a Proposition 51 case. The breakdown of damages is optional depending on the circumstances.<\/p>\n<p>If the jury answers \u201cyes\u201d to questions 1, 2, and 3, attorney fees and costs are recoverable from the individual defendant without any additional showing of any kind. (Welf. &amp; Inst. Code, \u00a7\u200915657.5(a).) Attorney fees are also recoverable from the employer, assuming that standard vicarious liability is shown. (See\u00a0Welf. &amp; Inst. Code, \u00a7\u200915657.5(c).) Incorporate questions 3 and 4 from\u00a0CACI No. VF-3700,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Negligence\u2014Vicarious Liability,<\/span>\u00a0to address the liability of the employer for the acts of the employee.<\/p>\n<p>Should the financial abuse in some way have caused the victim\u2019s death, the decedent\u2019s pain and suffering before death is recoverable on a showing by clear and convincing evidence that the individual defendant acted with recklessness, oppression, fraud, or malice. (See\u00a0Welf. &amp; Inst. Code, \u00a7\u200915657.5(b);\u00a0Code Civ. Proc., \u00a7\u2009377.34.) In such a case, in question 4, include only item 4a for past economic loss. But also include questions 5 and 6.<\/p>\n<p>If punitive damages are sought, incorporate a verdict form for punitive damages. (See\u00a0CACI Nos. VF-3900\u2013VF-3904.)<\/p>\n<p>If there are multiple causes of action, users may wish to combine the individual forms into one form. If different damages are recoverable on different causes of action, replace the damages tables in all of the verdict forms with\u00a0CACI No. VF-3920,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Damages on Multiple Legal Theories<\/span>.<\/p>\n<p>If the jury is being given the discretion under\u00a0Civil Code section 3288\u00a0to award prejudgment interest (see\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bullis v. Security Pac. Nat\u2019l Bank<\/span>\u00a0(1978) 21 Cal.3d 801, 814 [148 Cal.Rptr. 22, 582 P.2d 109]), give\u00a0CACI No. 3935,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Prejudgment Interest<\/span>.
