the warranty of merchantability occurs when a good becomes unfit for the ordinary purpose for which it is used. An exception occurs when the defect or nonconformity is caused by the buyer\u2019s unauthorized or unreasonable use under\u00a0Civil Code section 1794.3. \u2018It is a \u201cfamiliar\u201d and \u201clongstanding\u201d legal principle that \u201c\u2009\u2018[w]hen a proviso \u2026 carves an exception out of the body of a statute or contract those who set up such exception must prove it.\u2019\u2009\u201d [Citations.]\u2019 Defendant, as the party claiming the exemption from the Song-Beverly Act, had the burden to prove the exemption.\u2009\u2026 Plaintiff alleged the vehicle became unfit and presented uncontradicted evidence that the vehicle had ceased functioning; to avail itself of\u00a0Civil Code section 1794.3, defendant had to allege and prove that, notwithstanding the unfitness, the Song-Beverly Act did not apply due to plaintiff\u2019s improper use or maintenance.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Jones v.
