This is known as a \u201cbreach of an implied warranty.\u201d To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] bought a[n] [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">consumer good<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [from\/manufactured by\/distributed by] [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That, at the time of purchase, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] knew or had reason to know that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] intended to use the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">consumer good<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] for a particular purpose;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That, at the time of purchase, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] knew or had reason to know that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was relying on [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/its] skill and judgment to select or provide a [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">consumer good<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] that was suitable for that particular purpose;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] justifiably relied on [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s skill and judgment;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">consumer good<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was not suitable for the particular purpose;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">6.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">7.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s breach of the implied warranty was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised November 2018 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>If remedies are sought under the California Uniform Commercial Code, the plaintiff may be required to prove reasonable notification within a reasonable time. (Cal. U. Com. Code, \u00a7\u20092607(3).) If the court determines such proof is necessary, add the following element to this instruction:<\/p>\n<p>That [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span>] took reasonable steps to notify [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span>] within a reasonable time that the [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">consumer good<\/span>] was not suitable for its intended use;<\/p>\n<p>See also\u00a0CACI No.\u20021243,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Notification\/Reasonable Time<\/span>.<\/p>\n<p>If appropriate to the facts, add: \u201cIt is not necessary for [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span>] to prove the cause of a defect of the [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">consumer good<\/span>].\u201d The Song-Beverly Consumer Warranty Act does not require a consumer to prove the cause of the defect or failure, only that the consumer good \u201cdid not conform to the express warranty.\u201d (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Oregel v. American Isuzu Motors, Inc.<\/span>\u00a0(2001) 90 Cal.App.4th 1094, 1102, fn. 8 [109 Cal.Rptr.2d 583].)<\/p>\n<p>In addition to sales of consumer goods, the Consumer Warranty Act applies to leases of consumer goods\u2014see\u00a0Civil Code sections 1791(g)\u2013(i)\u00a0and\u00a01795.4. This instruction may be modified for use in cases involving the implied warranty of fitness in a lease of consumer goods. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cImplied Warranty of Fitness\u201d Defined.\u00a0Civil Code section 1791.1(b).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Remedies for Breach of Warranty of Fitness.\u00a0Civil Code section 1791.1(d).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Waiver of Warranty of Fitness.\u00a0Civil Code section 1792.3.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Song-Beverly Consumer Warranty Act: Right of Action.\u00a0Civil Code section 1794(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Measure of Damages.\u00a0Civil Code section 1794(b).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Manufacturer\u2019s Implied Warranty of Fitness.\u00a0Civil Code section 1792.1.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Retailer\u2019s or Distributor\u2019s Implied Warranty of Fitness.\u00a0Civil Code section 1792.2(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Damages for Nonconforming Goods.\u00a0California Uniform Commercial Code section 2714(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Damages for Breach of Warranty.\u00a0California Uniform Commercial Code section 2714(2).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe Consumer Warranty Act makes \u2026 an implied warranty [of fitness for a particular purpose] applicable to retailers, distributors, and manufacturers\u2009\u2026\u2009. An implied warranty of fitness for a particular purpose arises only where (1) the purchaser at the time of contracting intends to use the goods for a particular purpose, (2) the seller at the time of contracting has reason to know of this particular purpose, (3) the buyer relies on the seller\u2019s skill or judgment to select or furnish goods suitable for the particular purpose, and (4) the seller at the time of contracting has reason to know that the buyer is relying on such skill and judgment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Keith v. Buchanan<\/span>\u00a0(1985) 173 Cal.App.3d 13, 25 [220 Cal.Rptr. 392], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018A \u201cparticular purpose\u201d differs from the ordinary purpose for which the goods are used in that it envisages a specific use by the buyer which is peculiar to the nature of his business whereas the ordinary purposes for which goods are used are those envisaged in the concept of merchantability and go to uses which are customarily made of the goods in question.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">American Suzuki Motor Corp. v. Superior Court<\/span>\u00a0(1995) 37 Cal.App.4th 1291, 1295, fn. 2 [44 Cal.Rptr.2d 526], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe reliance elements are important to the consideration of whether an implied warranty of fitness for a particular purpose exists\u2009\u2026\u2009. The major question in determining the existence of an implied warranty of fitness for a particular purpose is the reliance by the buyer upon the skill and judgment of the seller to select an article suitable for his needs.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Keith<\/span>,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">supra<\/span>, 173 Cal.App.3d at p. 25, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe question of reimbursement or replacement is relevant only under [Civil Code] section 1793.2\u2009\u2026\u2009. [T]his section applies only when goods cannot be made to conform to the \u2018applicable\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">express<\/span>\u00a0warranties.\u2019 It has no relevance to the implied warranty of merchantability.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Music Acceptance Corp. v. Lofing<\/span>\u00a0(1995) 32 Cal.App.4th 610, 620 [39 Cal.Rptr.2d 159].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe Song-Beverly Act incorporates the provisions of [California Uniform Commercial Code] sections 2314\u00a0and\u00a02315. It \u2018supplements, rather than supersedes, the provisions of the California Uniform Commercial Code\u2019 by broadening a consumer\u2019s remedies to include costs, attorney\u2019s fees, and civil penalties.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">American Suzuki Motor Corp.<\/span>,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">supra<\/span>, 37 Cal.App.4th at p. 1295, fn. 2, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe notice requirement of [former Civil Code] section 1769 \u2026 is not an appropriate one for the court to adopt in actions by injured consumers against manufacturers with whom they have not dealt. As between the immediate parties to the sale [the notice requirement] is a sound commercial rule, designed to protect the seller against unduly delayed claims for damages. As applied to personal injuries, and notice to a remote seller, it becomes a booby-trap for the unwary.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Greenman v.
