(<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Jiagbogu v. Mercedes-Benz USA<\/span>\u00a0(2004) 118 Cal.App.4th 1235, 1245 [13 Cal.Rptr.3d 679].)<\/p>\n<p>Note that the factfinder\u2019s inquiry should be focused on overall reasonableness of the opportunities plaintiff gave defendant to make repairs. Therefore, while satisfying the rebuttable presumption (without having it overcome by defendant) is one way for plaintiff to satisfy the reasonable opportunities requirement, the plaintiff may do so in other ways instead. Likewise, because the statutory presumption is rebuttable, defendant is allowed an opportunity to overcome it.<\/p>\n<p>The rebuttable presumption concerning the number of repair attempts applies only to new motor vehicles\u2014see the Tanner Consumer Protection Act. (Civ. Code, \u00a7\u20091793.22(b).)<\/p>\n<p>The bracketed language in the first two optional paragraphs concerning notice made directly to the manufacturer are applicable only if \u201cthe manufacturer has clearly and conspicuously disclosed to the buyer, with the warranty or the owner\u2019s manual, the provisions of [the Tanner Consumer Protection Act] and that of [Civil Code section 1793.2(d)], including the requirement that the buyer must notify the manufacturer directly.\u201d (See\u00a0Civ. Code, \u00a7\u20091793.22(b)(3).) This is a matter that the judge should determine ahead of time as an issue of law. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Replacement or Reimbursement After Reasonable Number of Repair Attempts.\u00a0Civil Code section 1793.2(d)(2).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Reasonable Number of Repair Opportunities.\u00a0Civil Code section 1793.22(b).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe believe \u2026 that the only affirmative step the Act imposes on consumers is to \u2018permit[] the manufacturer a reasonable\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">opportunity<\/span>\u00a0to repair the vehicle.\u2019 Whether or not the manufacturer\u2019s agents choose to take advantage of the opportunity, or are unable despite that opportunity to isolate and make an effort to repair the problem, are matters for which the consumer is not responsible.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Oregel v.
