The remedy is replacement of the vehicle or restitution. (Civ. Code, \u00a7\u20091793.2(d)(2).) For claims involving other consumer goods, see\u00a0CACI No.\u20023240,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Reimbursement Damages\u2014Consumer Goods<\/span>.<\/p>\n<p>Incidental damages are recoverable as part of restitution. (Civ. Code, \u00a7\u20091793.2(d)(2)(B).) For an instruction on incidental damages, see\u00a0CACI No.\u20023242,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Incidental Damages<\/span>. See also\u00a0CACI No. 3243,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Consequential Damages<\/span>.<\/p>\n<p>The remedies for new motor vehicles provided by\u00a0Civil Code section 1793.2(d)(2)\u00a0apply to all claims under the Song-Beverly Consumer Warranty Act. (Civ. Code, \u00a7\u20091794(b).) These remedies are also available for implied-warranty claims. (See\u00a0Civ. Code, \u00a7\u20091791.1(d).) The first paragraph of this instruction can be modified if it is being used for claims other than those brought under\u00a0Civil Code section 1793.2(d)(2).<\/p>\n<p>Modify element 1 depending on whether plaintiff still has an outstanding obligation on the financing of the vehicle.<\/p>\n<p>The last two bracketed options are intended to be read in the alternative. Use the last bracketed option if the court desires for the jury to make the calculation of the deduction. The \u201cformula\u201d referenced in the last bracketed paragraph can be found at\u00a0Civil Code section 1793.2(d)(2)(C).<\/p>\n<p>Additional remedies under the California Uniform Commercial Code are provided for \u201cgoods.\u201d (See\u00a0Civ. Code, \u00a7\u20091794(b).) Although consumer goods and new motor vehicles are treated differently under\u00a0Civil Code section 1793.2, \u201cconsumer goods\u201d are defined broadly under Song-Beverly (see\u00a0Civ. Code, \u00a7\u20091791(a)\u00a0[\u201cconsumer goods\u201d means any new product or part thereof that is used, bought, or leased for use primarily for personal, family, or household purposes, except for clothing and consumables]). At least one court has applied the California Uniform Commercial Code remedies for new motor vehicles. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Krotin v. Porsche Cars North America, Inc.<\/span>\u00a0(1995) 38 Cal.App.4th 294, 302 [45 Cal.Rptr.2d 10].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Measure of Buyer\u2019s Damages.\u00a0Civil Code section 1794(b).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Replacement or Reimbursement After Reasonable Number of Repair Attempts: New Motor Vehicle.\u00a0Civil Code section 1793.2(d)(2).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A]s the conjunctive language in\u00a0Civil Code section 1794\u00a0indicates, the statute itself provides an additional measure of damages beyond replacement or reimbursement and permits, at the option of the buyer, the Commercial Code measure of damages which includes \u2018the cost of repairs necessary to make the goods conform.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Krotin, supra<\/span>, 38 Cal.App.4th at p. 302, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[I]n the usual situation, emotional distress damages are\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">not<\/span>\u00a0recoverable under the Song-Beverly Consumer Warranty Act.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Music Acceptance Corp. v. Lofing<\/span>\u00a0(1995) 32 Cal.App.4th 610, 625, fn. 15 [39 Cal.Rptr.2d 159], emphasis in original; see also\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Kwan v. Mercedes-Benz of N. Am.<\/span>\u00a0(1994) 23 Cal.App.4th 174, 187\u2013192 [28 Cal.Rptr.2d 371].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[F]inding an implied prohibition on recovery of finance charges would be contrary to both the Song-Beverly Consumer Warranty Act\u2019s remedial purpose and section 1793.2(d)(2)(B)\u2019s description of the refund remedy as restitution. A more reasonable construction is that the Legislature intended to allow a buyer to recover the entire amount actually expended for a new motor vehicle, including paid finance charges, less any of the expenses expressly excluded by the statute.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mitchell v. Blue Bird Body Co.<\/span>\u00a0(2000) 80 Cal.App.4th 32, 37 [95 Cal.Rptr.2d 81].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[Defendant] argues that [plaintiff] would receive a windfall if he is not required to pay for using the car after his buyback request. But to give [defendant] an offset for that use would reward it for its delay in replacing the car or refunding [plaintiff]\u2019s money when it had complete control over the length of that delay, and an affirmative statutory duty to replace or refund promptly.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Jiagbogu v. Mercedes-Benz USA<\/span>\u00a0(2004) 118 Cal.App.4th 1235, 1244 [13 Cal.Rptr.3d 679].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he imposition of a requirement that [plaintiff] mitigate his damages so as to avoid rental car expenses\u2014after [defendant] had a duty to respond promptly to [plaintiff]\u2019s demand for restitution\u2014would reward [defendant] for its delay in refunding [plaintiff]\u2019s money.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lukather v.
