SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction is for use if incidental damages are sought in an action under the Song-Beverly Consumer Warranty Act. Incidental damages are allowed as part of the restitution remedy for new motor vehicles. (Civ. Code, \u00a7\u20091793.2(d)(2)(B).) See also\u00a0CACI No. 3241,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Restitution From Manufacturer\u2014New Motor Vehicle<\/span>.<\/p>\n<p>With regard to claims for consumer goods, the availability of incidental damages may be limited. If the plaintiff has elected to accept the goods, incidental damages under\u00a0California Uniform Commercial Code section 2715\u00a0and the cost of repairs required to make the goods conform to the warranty are allowed. (Civ. Code, \u00a7\u20091794(b)(2).) If the buyer has rightfully rejected or justifiably revoked acceptance, incidental damages are allowed under\u00a0California Uniform Commercial Code sections 2711,\u00a02712, and\u00a02713\u00a0for the seller\u2019s nondelivery or repudiation of the contract or in connection with cover (obtaining replacement goods from another seller). (Civ. Code, \u00a7\u20091794(b)(1).) If any of these matters are disputed, additional instructions will be required on these points.<\/p>\n<p>If incidental damages are otherwise recoverable, they are recoverable regardless of the nature of the claim under Song-Beverly. (See\u00a0Civ. Code, \u00a7\u20091794(b)\u00a0[statute covers all Song-Beverly actions].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Measure of Buyer\u2019s Damages: Commercial Code Remedies Available.\u00a0Civil Code section 1794(b).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Restitution Includes Incidental Damages.\u00a0Civil Code section 1793.2(d)(2)(B).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Buyer\u2019s Remedies for Seller\u2019s Breach. California Uniform\u00a0Commercial Code section 2711(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Incidental Damages Recoverable.\u00a0California Uniform Commercial Code sections 2712(2),\u00a02713(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIncidental Damages\u201d Defined.\u00a0California Uniform Commercial Code section 2715(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn light of the relevant legislative history and express language in the Act, we conclude\u00a0California Uniform Commercial Code section 2715\u2019s reference to losses must be construed and applied in the context of monetary losses\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">actually<\/span>\u00a0incurred.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bishop v.
