data-housestyle=\"EMPHASIS_bf\">[the determination of the appropriate cost of [manufacture\/distribution] of a particular product must be reasonably related to the burden the product puts on [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s overall cost of doing business.]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[the determination of the cost of providing particular services must be reasonably related to the burden the service puts on [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s overall cost of doing business.] <br SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>Regarding the first bracketed sentence, if all of the defendant\u2019s products are approximately the same, there is no need to allocate the indirect expense, i.e., overhead, according to the unique \u201cburden\u201d each product generates. In such cases, this paragraph could unnecessarily confuse the jury and should be modified or deleted. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cDetermination of the defendant\u2019s cost has always been treated as an issue of fact.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pan Asia Venture Capital Corp. v. Hearst Corp.<\/span>\u00a0(1999) 74 Cal.App.4th 424, 432 [88 Cal.Rptr.2d 118].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThese statutes embody California\u2019s fully allocated cost standard, that is, a fair allocation of all fixed or variable costs associated with production of the article or product.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pan Asia Venture Capital Corp., supra,<\/span>\u00a074 Cal.App.4th at p. 432, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cCost is to be measured as \u2018the fair average cost of production over a reasonable time, rather than the cost of one item on a particular occasion.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pan Asia Venture Capital Corp., supra,<\/span>\u00a074 Cal.App.4th at p. 432, fn. 6, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cVariable costs are costs that vary with changes in output, while fixed costs are those that do not vary with changes in output.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Turnbull &amp; Turnbull v. ARA Transportation Inc.<\/span>\u00a0(1990) 219 Cal.App.3d 811, 820 [268 Cal.Rptr. 856].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cCalifornia employs a fully allocated cost standard to determine whether a sale has violated section 17043. Under sections 17026 and 17029 \u2026 cost means invoice cost plus the vendor\u2019s full cost of doing business or six percent.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">G.H.I.I. v.
