data-housestyle=\"EMPHASIS_bf\">(a)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Whether competitors offer to sell [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">tied product or service<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] separately from [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">tying product or service<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] or only as a unit;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(b)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Whether the combined product is composed of varying assortments of component parts;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(c)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Whether buyers are or can be charged separately for the [products\/services]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(d)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Whether [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] ever sells or offers to sell [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">tied product or service<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] separate from [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_bf\">Not all of these factors need be present in order for you to conclude that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">tying product or service<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] and [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">tied product or service<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] are separate and distinct [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">products or services, etc.<\/span><span class=\"SS_bf\" are sometimes sold separately from belts, a belt buckle is normally considered a component of a belt. Therefore, a belt and buckle would normally be considered one product under the law in this case. On the other hand, while belts and wallets are sometimes packaged and sold together, they are not normally considered components of a single product and are normally purchased separately. (2) Whether the combined product or service is composed of varying assortments of component parts. (3) Whether buyers are or can be charged separately for the allegedly separate products or services.
