To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] breached the duty of an attorney [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">describe duty<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised April 2004; Renumbered from CACI No. 605 December 2007; Revised May 2019, May 2020 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>The existence of a fiduciary relationship is a question of law. Whether an attorney has breached that fiduciary duty is a question of fact. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">David Welch Co. v. Erskine &amp; Tulley<\/span>\u00a0(1988) 203 Cal.App.3d 884, 890 [250 Cal.Rptr. 339], disapproved on other grounds in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lee v. Hanley<\/span>\u00a0(2015) 61 Cal.4th 1225, 1239 [191 Cal.Rptr.3d 536, 354 P.3d 334].)<\/p>\n<p>Give\u00a0CACI No. 430,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Causation: Substantial Factor<\/span>, with this instruction.<\/p>\n<p>The causation standard for an attorney\u2019s intentional breach of fiduciary duty differs from that for a negligent breach. If the plaintiff alleges an attorney\u2019s intentional breach of duty, do not include the optional last sentence of\u00a0CACI No. 430,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Causation: Substantial Factor<\/span>, on \u201cbut for\u201d causation. The \u201cbut for\u201d causation standard does not apply to an intentional breach of fiduciary duty. If the plaintiff alleges an attorney\u2019s negligent breach of duty, the \u201cbut for\u201d (\u201cwould have happened anyway\u201d) causation standard applies. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Knutson v. Foster<\/span>\u00a0(2018) 25 Cal.App.5th 1075, 1093\u20131094 [236 Cal.Rptr.3d 473]; see\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Viner v. Sweet<\/span>\u00a0(2003) 30 Cal.4th 1232 [135 Cal.Rptr.2d 629, 70 P.3d 1046].) If the plaintiff alleges a negligent breach of duty, give the optional last sentence of\u00a0CACI No. 430: \u201cConduct is not a substantial factor in causing harm if the same harm would have occurred without that conduct.\u201d<\/p>\n<p>If the plaintiff alleges both negligent breach and intentional or fraudulent breach, the jury must be instructed on both causation standards and it should be made clear which causation standard applies to which claim.<\/p>\n<p>If the harm allegedly caused by the defendant\u2019s conduct involves the outcome of a legal claim, the jury should be instructed with\u00a0CACI No. 601,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Negligent Handling of Legal Matter<\/span>, for the \u201cbut for\u201d standard. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Gutierrez v. Girardi<\/span>\u00a0(2011) 194 Cal.App.4th 925, 928, 933\u2013937 [125 Cal.Rptr.3d 210]\u00a0[discussing circumstances when a client need not show that they objectively would have obtained a better result in the underlying case in the absence of the attorney\u2019s breach (the trial-within-a-trial method)].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018The relation between attorney and client is a fiduciary relation of the very highest character.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Neel v. Magana, Olney, Levy, Cathcart &amp; Gelfand<\/span>\u00a0(1971) 6 Cal.3d 176, 189 [98 Cal.Rptr. 837, 491 P.2d 421].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018The breach of fiduciary duty can be based upon either negligence or fraud depending on the circumstances. It has been referred to as a species of tort distinct from causes of action for professional negligence [citation] and from fraud [citation].\u2019 \u2018The elements of a cause of action for breach of fiduciary duty are the existence of a fiduciary relationship, breach of fiduciary duty, and damages.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Knutson, supra<\/span>, 25 Cal.App.5th at pp. 1093\u20131094, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSubstantial factor causation is the correct causation standard for an intentional breach of fiduciary duty.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Knutson, supra<\/span>, 25 Cal.App.5th at p. 1094.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe trial court applied the legal malpractice standard of causation to [plaintiff]\u2019s intentional breach of fiduciary duty cause of action.
