Before the sale, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must then disclose to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">], the buyer, all facts that materially affect the value or desirability of the property that the investigation revealed or should have revealed.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] claims that [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/it] was harmed by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s breach of this duty. To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of seller<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s real estate [broker\/salesperson];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] acted on [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of seller<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s behalf for purposes of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert description of transaction, e.g., \u201cselling a residential property\u201d<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] failed to conduct a reasonably competent and diligent visual inspectionof the property;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That before the sale, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] failed to disclose to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] all facts that materially affected the value or desirability of the property that such an inspection would have revealed;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">6.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New June 2013; Revised May 2020 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>Give this instruction if the seller\u2019s real estate broker or salesperson did not conduct a visual inspection of the property and make disclosures to the buyer as required by\u00a0Civil Code section 2079(a). For an instruction on the fiduciary duty of a real estate broker to the broker\u2019s own client, see\u00a0CACI No. 4107,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Duty of Disclosure of Real Estate Broker to Client<\/span>.<\/p>\n<p>The duty created by\u00a0Civil Code section 2079\u00a0is not a fiduciary duty; it is strictly a limited duty created by statute. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Michel v. Moore &amp; Associates, Inc.<\/span>\u00a0(2007) 156 Cal.App.4th 756, 762 [67 Cal.Rptr.3d 797].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Statutory Duties of Seller\u2019s Real Estate Broker.\u00a0Civil Code section 2079(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Scope of Required Inspection.\u00a0Civil Code section 2079.3.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSection 2079 requires sellers\u2019 real estate brokers, and their cooperating brokers, to conduct a \u2018reasonably competent and diligent visual inspection of the property,\u2019 and to disclose all material facts such an investigation would reveal to a prospective buyer.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Field v. Century 21 Klowden-Forness Realty<\/span>\u00a0(1998) 63 Cal.App.4th 18, 23 [73 Cal.Rptr.2d 784], footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSection 2079 was enacted to codify and focus the holding in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Easton v. Strassburger, supra<\/span>, 152 Cal. App. 3d 90. In\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Easton<\/span>, the court recognized that case law imposed a duty on\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">sellers<\/span>\u2019 brokers to disclose material facts\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">actually known<\/span>\u00a0to the broker.\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Easton<\/span>\u00a0expanded the holdings of former decisions to include a requirement that sellers\u2019 brokers must diligently inspect residential property and disclose material facts they obtain from that investigation. Further, the case held sellers\u2019 brokers are chargeable with knowledge they\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">should have known<\/span>\u00a0had they conducted an adequate investigation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Field, supra<\/span>, 63 Cal.App.4th at p. 24, original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSection 2079 statutorily limits the duty of inspection recognized in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Easton<\/span>\u00a0to one requiring only a\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">visual<\/span>\u00a0inspection. Further, the statutory scheme expressly states a selling broker has no obligation to purchasers to investigate public records or permits pertaining to title or use of the property.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Field, supra<\/span>, 63 Cal.App.4th at p. 24, original italics; see\u00a0Civ. Code, \u00a7\u20092079.3.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe statutory duties owed by sellers\u2019 brokers under section 2079 are separate and independent of the duties owed by brokers to their own clients who are buyers.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">William L. Lyon &amp; Associates, Inc. v. Superior Court<\/span>\u00a0(2012) 204 Cal.App.4th 1294, 1305 [139 Cal.Rptr.3d 670].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn accordance with the clear and unambiguous language of section 2079, the inspection and disclosure duties of residential real estate brokers and their agents apply exclusively to prospective buyers, and not to other persons who are not parties to the real estate transaction. Only a transferee, that is, the ultimate purchaser, can recover from a broker or agent for breach of these duties.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Coldwell Banker Residential Brokerage Co. v. Superior Court<\/span>\u00a0(2004) 117 Cal.App.4th 158, 165 [11 Cal.Rptr.3d 564].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]e are not persuaded by Defendants\u2019 reliance on\u00a0Civil Code section 2079. Although we agree that that statute sets forth some of the duties of a real estate broker, it is not the only source of a broker\u2019s duties. \u2018Real estate brokers are subject to two sets of duties: those imposed by regulatory statutes, and those arising from the general law of agency.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ryan v.
