(See\u00a0Civ. Code, \u00a7\u20093439.01(m).) Read the second bracketed option for the second sentence if the transaction has been stipulated to or determined as a matter of law. Otherwise, read the first bracketed option. Include only the bracketed terms at the end of the first option that are at issue in the case. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cTransfer\u201d Defined.\u00a0Civil Code section 3439.01(m).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cOn its face, the UFTA applies to all transfers. Civil Code, section \u00a7\u20093439.01, subdivision (i) defines \u2018[t]ransfer\u2019 as \u2018every mode, direct or indirect, absolute or conditional, voluntary or involuntary, of disposing of or parting with an asset or an interest in an asset \u2026\u2009.\u2019 The UFTA excepts only certain transfers resulting from lease terminations or lien enforcement.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mejia v. Reed<\/span>\u00a0(2003) 31 Cal.4th 657, 664 [3 Cal.Rptr.3d 390, 74 P.3d 166], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cCivil Code section 3439.01, subdivision (m)\u00a0broadly defines \u2018transfer\u2019 to mean \u201cevery mode, direct or indirect, absolute or conditional, voluntary or involuntary, of disposing of or parting with an asset or an interest in an asset, and includes payment of money, release, lease, license, and creation of a lien or other encumbrance.\u2019 This definition is broad enough to include transfers of assets by means of executing on a judgment obtained by fraud or collusion.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Chen v. Berenjian<\/span>\u00a0(2019) 33 Cal.App.5th 811, 817 [245 Cal.Rptr.3d 378], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cUnder this definition, there is no doubt that an agreement made\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">during marriage<\/span>\u00a0in which a debtor-spouse agrees that the nondebtor-spouse\u2019s future earnings, income, or assets would be the nondebtor-spouse\u2019s separate property constitutes a transfer because the debtor-spouse is parting with an interest in an asset\u2014the community property represented by the other spouse\u2019s earnings\u2014in which he or she has a \u2018present [and] existing \u2026 interest[] during continuance of the marriage.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Sturm v. Moyer<\/span>\u00a0(2019) 32 Cal.App.5th 299, 308 [243 Cal.Rptr.3d 556], original italics, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn light of the suggestions raised by the legislative language and history, and the strong policy\u2014advanced by both the UFTA and\u00a0section 911 of the Family Code\u2014of protecting the rights of creditors from fraudulent transfers, we conclude that the Legislature must have intended that UFTA can apply to premarital agreements in which the prospective spouses agree that each spouse\u2019s earnings, income, and property acquired during marriage will be that spouse\u2019s separate property.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Sturm, supra<\/span>, 32 Cal.App.5th at p. 315.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cTransfers to bogus corporations that are wholly owned and controlled by the debtor are \u2018transfers\u2019 for purposes of the UFTA.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">PGA West Residential Assn., Inc. v.
