While the subcommittee been unable to locate cases that state this rule explicitly, cases have upheld the giving of this type of instruction where there is substantial evidence of peculiar value. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Damages for Loss of Property With Special Value.\u00a0Civil Code section 3355.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]his section deals with property which has a market value and also a peculiar value to the owner, and not with property having no market value.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Zvolanek v. Bodger Seeds, Ltd.<\/span>\u00a0(1935) 5 Cal.App.2d 106, 110 [42 P.2d 92].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cPeculiar value under\u00a0Civil Code section 3355\u00a0refers to a property\u2019s unique economic value, not its sentimental or emotional value.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">McMahon v. Craig<\/span>\u00a0(2009) 176 Cal.App.4th 1502, 1518 [97 Cal.Rptr.3d 555]\u00a0[\u201cpeculiar value\u201d refers to special characteristics that increase an animal\u2019s monetary value, not its abstract value as a companion to its owner].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he question of whether plaintiff proved \u2018peculiar value\u2019 was a factual question for the determination of the jury and that question was properly submitted to it for decision.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">King v.
