This means the party must persuade you that it is highly probable that the fact is true. I will tell you specifically which facts must be proved by clear and convincing evidence. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised October 2004, June 2015 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>Evidence Code section 502\u00a0requires the court to instruct the jury regarding which party bears the burden of proof on each issue and the requisite degree of proof.<\/p>\n<p>This instruction should be read immediately after\u00a0CACI No.\u2002200,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Obligation to Prove\u2014More Likely True Than Not True<\/span>, if the jury will have to decide an issue by means of the clear-and-convincing evidence standard. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">Burden of Proof.\u00a0Evidence Code section 115.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">Party With Burden of Proof.\u00a0Evidence Code section 500.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">\u201cProof by clear and convincing evidence is required \u2018where particularly important individual interests or rights are at stake,\u2019 such as the termination of parental rights, involuntary commitment, and deportation. However, \u2018imposition of even severe civil sanctions that do not implicate such interests has been permitted after proof by a preponderance of the evidence.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Weiner v. Fleischman<\/span>\u00a0(1991) 54 Cal.3d 476, 487 [286 Cal.Rptr. 40, 816 P.2d 892]\u00a0(quoting\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Herman &amp; MacLean v. Huddleston<\/span>\u00a0(1983) 459 U.S. 375, 389\u2013390).)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018Clear and convincing\u2019 evidence requires a finding of high probability.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">In re Angelia P.<\/span>\u00a0(1981) 28 Cal.3d 908, 919 [171 Cal.Rptr. 637, 623 P.2d 198].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">\u201cUnder the clear and convincing standard, the evidence must be \u2018\u2009\u201c\u2009\u2018\u2009\u201cso clear as to leave no substantial doubt\u201d\u2009\u2019\u2009\u201d\u2009\u2019 and \u2018\u2009\u201c\u2009\u2018\u2009\u201csufficiently strong to command the unhesitating assent of every reasonable mind.\u201d\u2009\u2019\u2009\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Butte Fire Cases<\/span>\u00a0(2018) 24 Cal.App.5th 1150, 1158 [235 Cal.Rptr.3d 228].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">\u201cWe decline to hold that\u00a0CACI No. 201\u00a0should be augmented to require that \u2018the evidence must be \u201cso clear as to leave no substantial doubt\u201d and \u201csufficiently strong as to command the unhesitating assent of every reasonable mind.\u201d\u2009\u2019 Neither\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">In re Angelia P., supra<\/span>, 28 Cal.3d 908, nor any more recent authority mandates that augmentation, and the proposed additional language is dangerously similar to that describing the burden of proof in criminal cases.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Nevarrez v.
