Otherwise, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of property owner<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] is entitled to wholesale value. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_2\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe\u00a0Fifth Amendment of the United States Constitution, as applied to the states by the\u00a0Fourteenth Amendment, conditions the power of eminent domain upon the payment of \u2018just compensation.\u2019 That constitutional requirement makes no distinction between real property and personal property. If personal property is taken by the government in the exercise of its eminent domain power, it must compensate the owner.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">City of Needles v. Griswold<\/span>\u00a0(1992) 6 Cal.App.4th 1881, 1891 [8 Cal.Rptr.2d 753].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe further acknowledge that where a condemner takes certain real property and the removal or relocation of either tangible or intangible personal property is impossible due to the condemnatory act, the owner is entitled to be justly compensated for the loss of property, regardless of its nature.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">San Diego Metropolitan Transit Development Bd. v. Handlery Hotel, Inc.<\/span>\u00a0(1999) 73 Cal.App.4th 517, 533 [86 Cal.Rptr.2d 473], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe general rule is that the Constitution does not require compensation for personal property not affixed to the condemned realty. Movable items of personal property are not \u2018taken\u2019 by the public entity when it condemns real property or a business; instead, under the Relocation Assistance Act, the public entity compensates the owner for the cost of moving the personal property to a new site.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">County of San Diego v. Cabrillo Lanes, Inc.<\/span>\u00a0(1992) 10 Cal.App.4th 576, 583 [12 Cal.Rptr.2d 613].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cBusiness inventory may be compensable under limited circumstances, i.e., where the loss results from the condemnatory act itself (e.g., the inventory cannot be relocated) rather than the personal circumstances of the condemnee (e.g., the owner has decided that he will not relocate).\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Chhour v. Community Redevelopment Agency of Buena Park<\/span>\u00a0(1996) 46 Cal.App.4th 273, 283 [53 Cal.Rptr.2d 585].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe goal of the eminent domain trial [is] \u2018to determine just compensation,\u2019 to wit, to put [condemnee] in \u2018as good a position\u2019 as if its business inventory had \u2018not been taken.\u2019 However, [condemnee] was only \u2018entitled to be reimbursed for the actual value of what [it] lost\u2014no more and no less.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People ex rel. Dept. of Transportation v. Clauser\/Wells Partnership<\/span>\u00a0(2002) 95 Cal.App.4th 1066, 1072\u20131073 [116 Cal.Rptr.2d 240], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cTo award [condemnee] retail value instead of wholesale value would result in a windfall to [condemnee]\u2014an award in excess of just compensation sufficient to make [condemnee] whole. Here, the proper standard of fair market value is the wholesale value. This is what a retailer, whose inventory of nonunique, fungible, and readily replaceable goods is damaged as a result of an act of inverse condemnation, should receive.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">McMahan\u2019s of Santa Monica v. City of Santa Monica<\/span>\u00a0(1983) 146 Cal.App.3d 683, 700 [194 Cal.Rptr. 582].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">In\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People ex rel. Dept. of Transportation, supra,<\/span>\u00a0the court held that a jury should have been allowed to consider expert witnesses\u2019 testimony on valuation of inventory based both on retail and wholesale value: \u201c[A]lthough any \u2018just and equitable\u2019 method could be proper, the jury would remain \u2018free to accept or reject\u2019 [an expert\u2019s] valuation.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People ex rel. Dept. of Transportation, supra,<\/span>\u00a095 Cal.App.4th at p. 1083, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he general rule in eminent domain actions is that \u2018the right to a jury trial \u2026 goes\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">only<\/span>\u00a0to the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">amount<\/span>\u00a0of compensation.
