However, you the jury are the exclusive judges of all questions of fact and of the credibility of the witnesses. This instruction should also be given if after deliberations have begun, the jury asks for additional guidance and the judge then comments on the evidence. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People v. Rodriguez<\/span>\u00a0(1986) 42 Cal.3d 730 [230 Cal.Rptr. 667, 726 P.2d 113].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Judge May Comment on the Evidence.\u00a0Article VI, section 10 of the California Constitution.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he decisions admonish that judicial comment on the evidence must be accurate, temperate, nonargumentative, and scrupulously fair. The trial court may not, in the guise of privileged comment, withdraw material evidence from the jury\u2019s consideration, distort the record, expressly or impliedly direct a verdict, or otherwise usurp the jury\u2019s ultimate factfinding power.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People v. Rodriguez, supra,<\/span>\u00a042 Cal.3d at p. 766, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A] trial court has \u2018broad latitude in fair commentary, so long as it does not effectively control the verdict. For example, it is settled that the court need not confine itself to neutral, bland, and colorless summaries, but\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">may focus critically on particular evidence,<\/span>\u00a0expressing views about its persuasiveness.\u2019 \u2026 \u2018[A] judge may restrict his comments to portions of the evidence or to the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">credibility of a single witness<\/span>\u00a0and need not sum up all the testimony, both favorable and unfavorable.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People v. Proctor<\/span>\u00a0(1992) 4 Cal.4th 499, 542 [15 Cal.Rptr.2d 340, 842 P.2d 1100], original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A] judge\u2019s power to comment on the evidence is not unlimited. He cannot withdraw material evidence from the jury or distort the testimony, and he must inform the jurors that they are the exclusive judges of all questions of fact and of the credibility of the witnesses. In civil cases, the court\u2019s powers of comment are less limited than in criminal cases, but they still must be kept within certain bounds. The court may express an opinion on negligence, but the court\u2019s remarks must be appropriate and fair.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lewis v.
