They may need to be modified depending on the facts of the case.<\/p>\n<p>Questions 2 and 3 may be replaced with one of the other options for elements 2 and 3 in\u00a0CACI No. 4603. Omit question 3 entirely, however, if the plaintiff allegedly refused to participate in an activity that would result in a violation or noncompliance with a statute, rule, or regulation. If the plaintiff allegedly refused to participate in an activity that would result in a violation or noncompliance with a statute, rule, or regulation, replace \u201cdisclosure of information\u201d in question 5 with \u201crefusal to [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify activity employee refused to participate in and what specific statute, rule, or regulation would be violated by that activity<\/span>].\u201d<\/p>\n<p>Questions 4 and 5 may be modified to allege constructive discharge. Questions 2 through 5 of\u00a0CACI No. VF-2408,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Constructive Discharge in Violation of Public Policy\u2014Plaintiff Required to Endure Intolerable Conditions for Improper Purpose That Violates Public Policy<\/span>, should be adapted and included in such a case.<\/p>\n<p>Question 7 presents the employer\u2019s affirmative defense that it would have made the same decision anyway for legitimate reasons even though the jury finds that retaliation for whistleblowing was also a contributing factor for the adverse action. Question 7 must be proved by clear and convincing evidence. (See\u00a0Lab. Code, \u00a7\u20091102.6.)<\/p>\n<p>If specificity is not required, users do not have to itemize all the damages listed in question 8 and do not have to categorize \u201ceconomic\u201d and \u201cnoneconomic\u201d damages, especially if it is not a Proposition 51 case. The breakdown of damages is optional depending on the circumstances.<\/p>\n<p>If there are multiple causes of action, users may wish to combine the individual forms into one form. If different damages are recoverable on different causes of action, replace the damages tables in all of the verdict forms with\u00a0CACI No. VF-3920,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Damages on Multiple Legal Theories<\/span>.<\/p>\n<p>If the jury is being given the discretion under\u00a0Civil Code section 3288\u00a0to award prejudgment interest (see\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bullis v. Security Pac.
