plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] claims that the parties consistently disregarded the contract\u2019s change-order process and that the final project was significantly different from the original project. (See\u00a0CACI No. 4523,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Contractor\u2019s Claim for Additional Compensation\u2014Abandonment of Contract<\/span>.)<\/p>\n<p>Contract abandonment cannot be alleged with regard to a public works contract. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Amelco Electric v. City of Thousand Oaks<\/span>\u00a0(2002) 27 Cal.4th 228, 238\u2013239 [115 Cal.Rptr.2d 900, 38 P.3d 1120].)<\/p>\n<p>For additional instructions on contract damages generally, see\u00a0CACI No. 350\u00a0et seq. in the Contracts series. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[O]nce the parties cease to follow the contract\u2019s change order process, and the final project is materially different from the project contracted for, the contract is deemed inapplicable or abandoned and is set aside. The plaintiff may then recover the reasonable costs for all of its work.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Amelco Elec.<\/span>,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">supra<\/span>, 27 Cal.4th at p. 238.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe contractor was \u2026 entitled, under the factual circumstances of this case [abandonment], to recover the reasonable value of the work it performed on a quantum meruit basis, without being limited by the original contract amount.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">C. Norman Peterson Co. v. Container Corp. of Am.<\/span>\u00a0(1985) 172 Cal.App.3d 628, 639 [218 Cal.Rptr. 592].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn the specific context of construction contracts \u2026\u2009, it has been held that when an owner imposes upon the contractor an excessive number of changes such that it can fairly be said that the scope of the work under the original contract has been altered, an abandonment of contract properly may be found. In these cases, the contractor, with the full approval and expectation of the owner, may complete the project. Although the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">contract<\/span>\u00a0may be abandoned, the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">work<\/span>\u00a0is not.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">C. Norman Peterson Co.<\/span>,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">supra<\/span>, 172 Cal.App.3d at p. 640, original italics, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThere was a triable issue of fact as to whether these changes for which plaintiff was seeking compensation were required. Moreover, because of the tremendous number of changes, there was an issue as to whether the contract had been abandoned by the parties and they proceeded apart from the contract. There was evidence that the job was completely redesigned after the contract was entered into.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Daugherty Co. v. Kimberly-Clark Corp.<\/span>\u00a0(1971) 14 Cal.App.3d 151, 156 [92 Cal.Rptr. 120].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A]bandonment requires a finding that\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">both<\/span>\u00a0parties intended to disregard the contract, and abandonment may be implied from the acts of the parties.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">C. Norman Peterson Co.<\/span>,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">supra<\/span>, 172 Cal.App.3d at p. 643, original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018Once the plaintiff has established the amount which he has been induced to expend, the defendant must show that the expenses of the party injured have been extravagant and unnecessary for the purpose of carrying out the contract.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">C.
