Code, \u00a7\u200951) or other characteristic on the basis of which the defendant alleges that the defendant has been arbitrarily discriminated against. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Marina Point, Ltd. v. California has brought such landlords within the embrace of the broad statutory provisions of the Unruh Act,\u00a0Civil Code section 51. Emanating from and modeled upon traditional \u2018public accommodations\u2019 legislation, the Unruh Act expanded the reach of such statutes from common carriers and places of public accommodation and recreation, e.g., railroads, hotels, restaurants, theaters and the like, to include \u2018all business establishments of every kind whatsoever.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Marina Point, Ltd., supra<\/span>, 30 Cal.3d at pp. 730\u2013731, footnote omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he \u2018identification of particular bases of discrimination\u2014color, race, religion, ancestry, and national origin\u2014<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">is illustrative rather than restrictive<\/span>. Although the legislation has been invoked primarily by persons alleging discrimination on racial grounds, its language and its history compel the conclusion that the Legislature intended to prohibit\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">all arbitrary discrimination by business establishments<\/span>.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Marina Point, Ltd., supra<\/span>, 30 Cal.3d at p. 732, original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe hold that defendant should have been permitted to produce proof of the allegations of his special defenses of discrimination, which if proven would bar the court from ordering his eviction because such \u2018state action\u2019 would be violative of both federal and state Constitutions.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Abstract Inv.
