To succeed on this defense, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\/ [or] a member of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s household] was a victim of [domestic violence\/sexual assault\/stalking\/human trafficking\/ [or] abuse of an elder or dependent adult];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the act[s] of [domestic violence\/sexual assault\/stalking\/human trafficking\/ [or] abuse of an elder or dependent adult] [was\/were] documented in a [court order\/law enforcement report\/statement of a third party acting in a professional capacity];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the person who committed the act[s] of [domestic violence\/sexual assault\/stalking\/human trafficking\/ [or] abuse of an elder or dependent adult] is not also a tenant of the same living unit as [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] filed this lawsuit because of the act[s] of [domestic violence\/sexual assault\/stalking\/human trafficking\/ [or] abuse of an elder or dependent adult].<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Even if [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] proves all of the above, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] may still evict [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] if [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] proves both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[Either] [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] allowed the person who committed the act[s] of [domestic violence\/sexual assault\/stalking\/human trafficking\/ [or] abuse of an elder or dependent adult] to visit the property after [the taking of a police report\/issuance of a court order] against that person;<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[or]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] reasonably believed that the presence of the person who committed the act[s] of [domestic violence\/sexual assault\/stalking\/human trafficking\/ [or] abuse of an elder or dependent adult] posed a physical threat to [other persons with a right to be on the property\/[or] another tenant\u2019s right of quiet possession];<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] previously gave at least three days\u2019 notice to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] to correct this situation. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New December 2011; Revised June 2013, June 2014, January 2019, May 2020 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction is a tenant\u2019s affirmative defense alleging that the tenant is being evicted because the tenant was the victim of domestic violence, sexual assault, stalking, human trafficking, or elder or dependent adult abuse. (See\u00a0Code Civ. Proc., \u00a7\u20091161.3.) If the tenant establishes the elements of the defense, the landlord may attempt to establish a statutory exception that would allow the eviction. The last part of the instruction sets forth the exception.<\/p>\n<p>All protected statuses are defined by statute. (See\u00a0Civ. Code, \u00a7\u20091708.7\u00a0[stalking];\u00a0Code Civ. Proc., \u00a7\u20091219\u00a0[sexual assault];\u00a0Fam. Code, \u00a7\u20096211\u00a0[domestic violence];\u00a0Pen. Code, \u00a7\u2009236.1\u00a0[human trafficking];\u00a0Welf. &amp; Inst. Code, \u00a7\u200915610.07\u00a0[abuse of elder or dependent adult].) Consider an additional instruction defining the protected status to make the meaning clear to the jury.<\/p>\n<p>The acts of domestic violence, sexual assault, stalking, human trafficking, or elder or dependent adult abuse must be documented in a court order, law enforcement report, or tenant and qualified third-party statement (element 2). (Code Civ. Proc., \u00a7\u20091161.3(a)(1)(C),\u00a0(D).) A \u201cqualified third party\u201d is a health practitioner, domestic violence counselor, a sexual assault counselor, or a human trafficking caseworker. (Code Civ. Proc., \u00a7\u20091161.3(d)(3).)<\/p>\n<p>Under the exception the tenant may be evicted if the landlord reasonably believes that the presence of the perpetrator poses a physical threat to other tenants, guests, invitees, or licensees, or to a tenant\u2019s right to quiet possession pursuant to\u00a0section 1927 of the Civil Code. (Code Civ. Proc., \u00a7\u20091161.3(b)(1)(B).) In the second option for element 1 of the landlord\u2019s response, this group has been expressed as \u201cother persons with a right to be on the property.\u201d If more specificity is required, use the appropriate words from the statute.<\/p>\n<p>The tenant must prove that the perpetrator is not a tenant of the same \u201cdwelling unit\u201d (see\u00a0Code Civ. Proc., \u00a7\u20091161.3(a)(2)), which is expressed in element 3 as \u201cliving unit.\u201d Presumably, the legislative intent is to permit the perpetrator to be evicted notwithstanding that the victim will be evicted also. The term \u201cdwelling unit\u201d is not defined. In a multi-unit building, the policies underlying the statute would support defining \u201cdwelling unit\u201d to include a single unit or apartment, but not the entire building.
