data-housestyle=\"EMPHASIS_it\">name of settling defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] and [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">].<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Under this agreement, the amount of money that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of settling defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] will have to pay to [<\/span><span A \u201cMary Carter\u201d agreement calls for the settling defendant to participate in the trial on the plaintiff\u2019s behalf, and provides for a settling defendant to be credited for amounts the plaintiff recovers from nonsettling defendants. It is secret and raises concerns of collusion and the potential for fraud. The interests of the parties are realigned in a manner not apparent to the trier of fact. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Diamond v. Reshko<\/span>\u00a0(2015) 239 Cal.App.4th 828, 843, fn. 7 [191 Cal.Rptr.3d 438].)<\/p>\n<p>The court must give this instruction on the motion of any party unless it finds that disclosure will create substantial danger of undue prejudice, of confusing the issues, or of misleading the jury. (Code Civ. Proc., \u00a7\u2009877.5(a)(2).)<\/p>\n<p>If the settling defendant is an entity, insert the name of the witness who testified on behalf of the entity and include the bracketed language in the third paragraph.<\/p>\n<p>See\u00a0CACI No. 217,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Evidence of Settlement<\/span>. See also\u00a0CACI No. 3926,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Settlement Deduction<\/span>. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">Evidence of Settlement.\u00a0Code of Civil Procedure section 877.5(a)(2).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">\u201c[W]hen a defendant is a party to a sliding scale settlement, which is also called a \u2018Mary Carter\u2019 agreement, that agreement must be disclosed to the jury if the settling defendant testifies at trial, unless the court finds that the disclosure will create a substantial danger of undue prejudice.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Diamond, supra<\/span>, 239 Cal.App.4th at p. 843.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">Evidence of a settlement agreement is admissible to show bias or prejudice of an adverse party. Relevant evidence includes evidence relevant to the credibility of a witness. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Moreno v. Sayre<\/span>\u00a0(1984) 162 Cal.App.3d 116, 126 [208 Cal.Rptr. 444].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022 <\/span><span class=\"SS_ListItemContent\">Evidence of a prior settlement is not automatically admissible. \u201cEven if it appears that a witness could have been influenced in his testimony by the payment of money or the obtaining of a dismissal, the party resisting the admission of such evidence may still appeal to the court\u2019s discretion to exclude it under section 352 of the code.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Granville v.
