To succeed on this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was negligent; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s negligence was a substantial factor in causing [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] harm.<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">If [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] proves the above, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s damages are reduced by your determination of the percentage of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s responsibility. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Drust v. Drust<\/span>\u00a0(1980) 113 Cal.App.3d 1, 6 [169 Cal.Rptr. 750].)<\/p>\n<p>If there are multiple defendants or alleged nondefendant tortfeasors, also give\u00a0CACI No. 406,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Apportionment of Responsibility<\/span>. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]e conclude that:\u2009\u2026 The doctrine of comparative negligence is preferable to the \u2018all-or-nothing\u2019 doctrine of contributory negligence from the point of view of logic, practical experience, and fundamental justice;\u2009\u2026\u2009.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Li v. Yellow Cab Co.<\/span>\u00a0(1975) 13 Cal.3d 804, 808 [119 Cal.Rptr. 858, 532 P.2d 1226].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe comparative fault doctrine \u2018is designed to permit the trier of fact to consider all relevant criteria in apportioning liability. The doctrine \u201cis a flexible, commonsense concept, under which a jury properly may consider and evaluate the relative responsibility of various parties for an injury (whether their responsibility for the injury rests on negligence, strict liability, or other theories of responsibility), in order to arrive at an \u201cequitable apportionment or allocation of loss.\u2019 [Citation.]\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pfeifer v. John Crane, Inc.<\/span>\u00a0(2013) 220 Cal.App.4th 1270, 1285 [164 Cal.Rptr.3d 112].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWhere contributory negligence is asserted as a defense, and where there is \u2018some evidence of a substantial character\u2019 to support a finding that such negligence occurred, it is prejudicial error to refuse an instruction on this issue, since defendant is thereby denied a basic theory of his defense.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Hasson v. Ford Motor Co.<\/span>\u00a0(1977) 19 Cal.3d 530, 548 [138 Cal.Rptr. 705, 564 P.2d 857].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe use by the trial court of the phrase \u2018contributory negligence\u2019 in instructing \u2018on the concept of comparative negligence is innocuous.\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Li v. Yellow Cab Co.<\/span>\u00a0[citation] abolished the legal doctrine, but not the phrase or the concept of \u2018contributory negligence.\u2019 A claimant\u2019s negligence contributing causally to his own injury may be considered now not as a bar to his recovery, but merely as a factor to be considered in measuring the amount thereof.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bradfield v. Trans World Airlines, Inc.<\/span>\u00a0(1979) 88 Cal.App.3d 681, 686 [152 Cal.Rptr. 172].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cGenerally, a defendant has the burden of establishing that some nonzero percentage of fault is properly attributed to the plaintiff, other defendants, or nonparties to the action.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pfeifer, supra<\/span>, 220 Cal.App.4th at p. 1285.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]ithin the comparative fault system, when an employer is liable solely on a theory of respondeat superior, \u2018the employer\u2019s share of liability for the plaintiff\u2019s damages corresponds to the share of fault that the jury allocates to the employee.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">CRST, Inc. v. Superior Court<\/span>\u00a0(2017) 11 Cal.App.5th 1255, 1261 [218 Cal.Rptr.3d 664].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[P]retreatment negligence by the patient does not warrant a jury instruction on contributory or comparative negligence. This view is supported by\u00a0comment m to section 7 of the Restatement Third of Torts: Apportionment of Liability, which states: \u2018[I]n a case involving negligent rendition of a service, including medical services, a factfinder does not consider any plaintiff\u2019s conduct that created the condition the service was employed to remedy.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Harb v.
