class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Liability of Person of \u201cUnsound Mind.\u201d\u00a0Civil Code section 41.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Restatement Second of Torts, section 283C, provides: \u201cIf the actor is ill or otherwise physically disabled, the standard of conduct to which he must conform to avoid being negligent is that of a reasonable man under like disability.\u201d (See also\u00a0<span class=\"SS_it\" Murray<\/span>\u00a0(1955) 135 Cal.App.2d 478, 482 [287 P.2d 505];\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Jones v. Bayley<\/span>\u00a0(1942) 49 Cal.App.2d 647, 654 [122 P.2d 293].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Persons with mental illnesses are not covered by the same standard as persons with physical illnesses. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bashi v. Wodarz<\/span>\u00a0(1996) 45 Cal.App.4th 1314, 1323 [53 Cal.Rptr.2d 635].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Restatement Second of Torts, section 283B, provides: \u201cUnless the actor is a child, his insanity or other mental deficiency does not relieve the actor from liability for conduct which does not conform to the standard of a reasonable man under like circumstances.\u201d<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">As to contributory negligence, the courts agree with the Restatement\u2019s position that mental deficiency that falls short of insanity does not excuse conduct that is otherwise contributory negligence.
