data-housestyle=\"EMPHASIS_it\">name of plaintiff\/name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] proves that one of the following is true:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(a)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">The violation was reasonable because of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify type of \u201cincapacity\u201d<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]; [or]<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(b)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Despite using reasonable care, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was not able to obey the law; [or]<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(c)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of plaintiff\/name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] faced an emergency that was not caused by [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] own misconduct; [or]<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(d)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">Obeying the law would have involved a greater risk of harm to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] or to others; [or]<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">(e)<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Other reason excusing or justifying noncompliance<\/span>.<span class=\"SS_bf\" SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>The burden of proof shifts from the party asserting a negligence per se claim to the party claiming an excuse for violating a law. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Baker-Smith v. Skolnick<\/span>\u00a0(2019) 37 Cal.App.5th 340, 347 [249 Cal.Rptr.3d 514].) Factor (b), regarding an attempt to comply with the applicable statute or regulation, should not be given if the evidence does not show such an attempt. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Atkins v. Bisigier<\/span>\u00a0(1971) 16 Cal.App.3d 414, 423 [94 Cal.Rptr. 49].) Factor (b) should be used only in special cases because it relies on the concept of due care to avoid a charge of negligence per se. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Casey v. Russell<\/span>\u00a0(1982) 138 Cal.App.3d 379, 385 [188 Cal.Rptr. 18].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Rebuttal of Presumption of Negligence per se.\u00a0Evidence Code section 669(b)(1).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn our opinion the correct test is whether the person who has violated a statute has sustained the burden of showing that he did what might reasonably be expected of a person of ordinary prudence, acting under similar circumstances, who desired to comply with the law.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Alarid v. Vanier<\/span>\u00a0(1958) 50 Cal.2d 617, 624 [327 P.2d 897].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he presumption of negligence codified in\u00a0Evidence Code section 669, subdivision (a), may be rebutted by proof that \u2018[t]he person violating the statute, ordinance, or regulation did what might reasonably be expected of a person of ordinary prudence, acting under similar circumstances, who desired to comply with the law.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Taulbee v. EJ Distribution Corp.<\/span>\u00a0(2019) 35 Cal.App.5th 590, 597 [247 Cal.Rptr.3d 538].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAn excuse instruction is improper unless special circumstances exist.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Baker-Smith, supra,<\/span>\u00a037 Cal.App.5th at p. 345.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe Restatement Second of Torts illustrates the types of situations which may justify or excuse a violation of the statute: [\u00b6] \u2018(a) [T]he violation is reasonable because of the actor\u2019s incapacity [e.g., a small child runs into the street without looking, in violation of statute requiring pedestrians to look both ways before crossing]; [\u00b6] \u2018(b) [H]e neither knows nor should know of the occasion for compliance; [\u00b6] \u2018(c) [H]e is unable after reasonable diligence or care to comply [e.g., a statute provides that railroads must keep fences clear of snow. A heavy blizzard covers the fences with snow and, acting promptly and reasonably, the railroad company is unable to remove all the snow for 3 days. Someone crosses the fence on the snow mound and is injured.
