class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] own safety that a reasonably careful employee would use under the same conditions.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">In deciding whether [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was negligent, you should consider how much attention [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] work demanded. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Shuff v. Irwindale Trucking Co.<\/span>\u00a0(1976) 62 Cal.App.3d 180, 187 [132 Cal.Rptr. 897].)<\/p>\n<p>An instruction on this principle is \u201caimed at situations where the employment conditions lessen the plaintiff\u2019s ability to take precautions.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Von Beltz v. Stuntman, Inc.<\/span>\u00a0(1989) 207 Cal.App.3d 1467, 1485 [255 Cal.Rptr. 755].) It does not apply where the plaintiff has ample opportunity to consider various precautions (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">ibid.<\/span>) or when employees act pursuant to choice rather than necessity. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Roberts v. Guillory<\/span>\u00a0(1972) 25 Cal.App.3d 859, 861\u2013862].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">This type of instruction \u201csoften[ed] the impact of instructing on the issue of contributory negligence\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Young v. Aro Corp.<\/span>\u00a0(1974) 36 Cal.App.3d 240, 244 [111 Cal.Rptr. 535]) at a time when contributory negligence was a complete bar to a plaintiff\u2019s recovery. The instruction may be given in cases involving comparative fault. (See, e.g.,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Johnson v. Tosco Corp.<\/span>\u00a0(1991) 1 Cal.App.4th 123, 136\u2013137 [1 Cal.Rptr.2d 747].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIt has long been recognized that \u2018where a person must work in a position of possible danger the amount of care which he is bound to exercise for his own safety may well be less by reason of the necessity of his giving attention to his work than would otherwise be the case.\u2019 [Citations].\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Austin v. Riverside Portland Cement Co.<\/span>\u00a0(1955) 44 Cal.2d 225, 239 [282 P.2d 69].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cConsidered in the light of the realities of his working life, the laborer\u2019s duty may become considerably restricted in scope. In some instances he may find himself powerless to abandon the task at hand with impunity whenever he senses a possible danger; in others, he may be uncertain as to which person has supervision of the job or control of the place of employment, and therefore unsure as to whom he should direct his complaint; in still others, having been encouraged to continue working under conditions where danger lurks but has not materialized, he may be baffled in making an on-the-spot decision as to the imminence of harm. All of these factors enter into a determination whether his conduct falls below a standard of due care.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Gyerman v.
