and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s furnishing alcoholic beverages to [[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\/[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of minor<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]] was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New December 2011; (See\u00a0Civ. Code, \u00a7\u20091714(d).) For an instruction for commercial liability, see\u00a0CACI No. 422,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Sale of Alcoholic Beverages to Obviously Intoxicated Minors<\/span>.<\/p>\n<p>Under the statute, the minor may sue for the minor\u2019s own injuries, or a third person may sue for injuries caused by the minor. (Civ. Code, \u00a7\u20091714(d)(2).) If the minor is the plaintiff, use the appropriate pronoun throughout. If the plaintiff is a third person, select \u201c[<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of minor<\/span>]\u201d throughout and include \u201cby [<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of minor<\/span>]\u201d in element 4. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">No Social Host Liability for Furnishing Alcohol.\u00a0Civil Code section 1714(c).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Exception to Nonliability.\u00a0Civil Code section 1714(d).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAlthough the claim against [host] appears to fall within the section 1714, subdivision (d) exception, plaintiffs cannot bootstrap respondents into that exception by alleging that respondents conspired with or aided and abetted [host] by providing alcoholic beverages that were furnished to [minor]. Subdivision (b) of section 1714 unequivocally states that \u2018the furnishing of alcoholic beverages is not the proximate cause of injuries resulting from intoxication\u2009\u2026\u2009.\u2019 This provision necessarily precludes liability against anyone who furnished alcohol to someone who caused injuries due to intoxication. The exception set forth in subdivision (d) vitiates subdivision (b) for a very narrow class of claims: claims against an adult who knowingly furnishes alcohol at his or her residence to a person he or she knows is under the age of 21. Because respondents are not alleged to have furnished alcohol to [minor] at their residences, plaintiffs\u2019 claims against them are barred because, as a matter of statutory law, plaintiffs cannot establish that respondents\u2019 actions proximately caused plaintiffs\u2019 injuries.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Rybicki v. Carlson<\/span>\u00a0(2013) 216 Cal.App.4th 758, 764 [157 Cal.Rptr.3d 660].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWe shall make no effort to state definitively the meaning of the word \u2018furnishes\u2019 \u2026\u2009. As used in a similar context the word \u2018furnish\u2019 has been said to mean: \u2018\u2009\u201cTo supply; to offer for use, to give, to hand.\u201d\u2009\u2019 It has also been said the word \u2018furnish\u2019 is synonymous with the words \u2018supply\u2019 or \u2018provide.\u2019 In relation to a physical object or substance, the word \u2018furnish\u2019 connotes possession or control over the thing furnished by the one who furnishes it. The word \u2018furnish\u2019 implies some type of affirmative action on the part of the furnisher; failure to protest or attempt to stop another from imbibing an alcoholic beverage does not constitute \u2018furnishing.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bennett v. Letterly<\/span>\u00a0(1977) 74 Cal.App.3d 901, 904\u2013905 [141 Cal.Rptr. 682], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAs used in liquor laws, \u2018furnish\u2019 means to provide in any way, and includes giving as well as selling.\u2009\u2026 [\u00b6] California courts have interpreted the terms \u2018furnish\u2019 and \u2018furnished\u2019 as requiring an affirmative act by the purported furnisher to supply the alcoholic beverage to the drinker.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fiorini v.
