data-housestyle=\"EMPHASIS_bf\">] fails to use the level of skill, knowledge, and care in diagnosis and treatment that other reasonably careful [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert type of nurses<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] would use in similar circumstances. This level of skill, knowledge, and care is sometimes referred to as \u201cthe standard of care.\u201d<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[You must determine the level of skill, knowledge, and care that other reasonably careful [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert type of nurses<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] would use in similar circumstances based only on the testimony of the expert witnesses [including [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]] who have testified in this case.] <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised October 2004, June 2010 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>The appropriate level of nurse should be inserted where indicated\u2014i.e., registered nurse, licensed vocational nurse, nurse practitioner.<\/p>\n<p>The second paragraph should be included unless the court determines that expert testimony is not necessary to establish the standard of care. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A] nurse is negligent if he or she fails to meet the standard of care\u2014that is, fails to use the level of skill, knowledge, and care that a reasonably careful nurse would use in similar circumstances.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Massey v. Mercy Med. Ctr. Redding<\/span>\u00a0(2009) 180 Cal.App.4th 690, 694 [103 Cal.Rptr.3d 209]\u00a0[citing this instruction].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018[T]oday\u2019s nurses are held to strict professional standards of knowledge and performance.\u2019 But \u2018[s]ome difficulties are presented [in the nursing malpractice context] by the fact that a nurse\u2019s traditional role has involved \u201cboth routine, nontechnical tasks as well as specialized nursing tasks. If, in considering the case law in this area, the dispute is analyzed in terms of what action by the nurse is being complained about, it is possible to make some sense out of the relevant decisions.\u201d\u2009\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Massey, supra<\/span>, 180 Cal.App.4th at p. 697, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[A] nurse\u2019s conduct must not be measured by the standard of care required of a physician or surgeon, but by that of other nurses in the same or similar locality and under similar circumstances.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lattimore v. Dickey<\/span>\u00a0(2015) 239 Cal.App.4th 959, 969 [191 Cal.Rptr.3d 766].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">The jury should not be instructed that the standard of care for a nurse practitioner must be measured by the standard of care for a physician or surgeon when the nurse is examining a patient or making a diagnosis. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fein v. Permanente Medical Group<\/span>\u00a0(1985) 38 Cal.3d 137, 150 [211 Cal.Rptr. 368, 695 P.2d 665].) Courts have observed that nurses are trained, \u201cbut to a lesser degree than a physician, in the recognition of the symptoms of diseases and injuries.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cooper v.
