plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] claims that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s failure to protect [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was a substantial factor in causing [injury to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\/the death of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]]. To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was a psychotherapist;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s patient;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] communicated to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] a serious threat of physical violence;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was a reasonably identifiable victim of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s threat;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [injured [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">\/<\/span>killed [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">6.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] failed to make reasonable efforts to protect [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff\/decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">7.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s failure was a substantial factor in causing [[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s injury\/the death of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of decedent<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Derived from former CACI No. 503 April 2007; (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Tarasoff v. Regents of Univ. of Cal.<\/span>\u00a0(1976) 17 Cal.3d 425 [131 Cal.Rptr. 14, 551 P.2d 334].) The liability imposed by\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Tarasoff<\/span>\u00a0is modified by the provisions of\u00a0Civil Code section 43.92(a). First read\u00a0CACI No. 503B,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Affirmative Defense\u2014Psychotherapist\u2019s Communication of Threat to Victim and Law Enforcement<\/span>, if the therapist asserts that the therapist is immune from liability under\u00a0Civil Code section 43.92(b)\u00a0because the therapist made reasonable efforts to communicate the threat to the victim and to a law enforcement agency.<\/p>\n<p>In a wrongful death case, insert the name of the decedent victim where applicable. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Limited Psychotherapist Immunity.\u00a0Civil Code section 43.92(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]herapists cannot escape liability merely because [the victim] was not their patient. When a therapist determines, or pursuant to the standards of his profession should determine, that his patient presents a serious danger of violence to another, he incurs an obligation to use reasonable care to protect the intended victim against such danger. The discharge of this duty may require the therapist to take one or more of various steps, depending upon the nature of the case. Thus it may call for him to warn the intended victim or others likely to apprise the victim of the danger, to notify the police, or to take whatever other steps are reasonably necessary under the circumstances.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Tarasoff, supra,<\/span>\u00a017 Cal.3d at p. 431.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Civil Code section 43.92\u00a0was enacted to limit the liability of psychotherapists under\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Tarasoff<\/span>\u00a0regarding a therapist\u2019s duty to warn an intended victim. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Barry v. Turek<\/span>\u00a0(1990) 218 Cal.App.3d 1241, 1244\u20131245 [267 Cal.Rptr. 553].) Under this provision, \u201c[p]sychotherapists thus have immunity from\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Tarasoff<\/span>\u00a0claims except where the plaintiff proves that the patient has communicated to his or her psychotherapist a serious threat of physical violence against a reasonably identifiable victim or victims.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Barry, supra,<\/span>\u00a0218 Cal.App.3d at p. 1245.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWhen the communication of the serious threat of physical violence is received by the therapist from a member of the patient\u2019s immediate family and is shared for the purpose of facilitating and furthering the patient\u2019s treatment, the fact that the family member is not technically a \u2018patient\u2019 is not crucial to the statute\u2019s purpose.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ewing v. Goldstein<\/span>\u00a0(2004) 120 Cal.App.4th 807, 817 [15 Cal.Rptr.3d 864].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSection 43.92 strikes a reasonable balance in that it does not compel the therapist to predict the dangerousness of a patient. Instead, it requires the therapist to attempt to protect a victim under limited circumstances, even though the therapist\u2019s disclosure of a patient confidence will potentially disrupt or destroy the patient\u2019s trust in the therapist. However, the requirement is imposed upon the therapist only after he or she determines that the patient has made a credible threat of serious physical violence against a person.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Calderon v.
