data-housestyle=\"EMPHASIS_bf\">] claims [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was negligent because [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not give [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] enough notice before withdrawing from the case. To succeed, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] withdrew from [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s care and treatment; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not provide sufficient notice for [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] to obtain another medical practitioner.<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">However, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was not negligent if [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] proves that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] consented to the withdrawal or declined further medical care. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_2\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">As a general proposition, \u201ca physician who abandons a patient may do so \u2018only \u2026 after due notice, and an ample opportunity afforded to secure the presence of other medical attendance.\u2019 [Citation.]\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Payton v. Weaver<\/span>\u00a0(1982) 131 Cal.App.3d 38, 45 [182 Cal.Rptr. 225].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cA physician cannot just walk away from a patient after accepting the patient for treatment.\u2009\u2026 In the absence of the patient\u2019s consent, the physician must notify the patient he is withdrawing and allow ample opportunity to secure the presence of another physician.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Hongsathavij v. Queen of Angels\/Hollywood Presbyterian Medical Center<\/span>\u00a0(1998) 62 Cal.App.4th 1123, 1138 [73 Cal.Rptr.2d 695].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWhen a competent, informed adult directs the withholding or withdrawal of medical treatment, even at the risk of hastening or causing death, medical professionals who respect that determination will not incur criminal or civil liability: the patient\u2019s decision discharges the physician\u2019s duty.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Thor v.
