To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] negligently failed to [diagnose\/ [or] warn [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s parents of] the risk that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] would be born with a [genetic impairment\/disability];]<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">or<\/span>]<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] negligently failed to [perform appropriate tests\/advise [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s parents of tests] that would more likely than not have disclosed the risk that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] would be born with a [genetic impairment\/disability];]<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was born with a [genetic impairment\/disability];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That if [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s parents had known of the risk of [genetic impairment\/disability], [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] mother would not have conceived [him\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [or would not have carried the fetus to term]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s negligence was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s parents to have to pay extraordinary expenses for [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Read also\u00a0CACI No. 512,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Wrongful Birth\u2014Essential Factual Elements<\/span>, if the parents\u2019 cause of action for wrongful birth is joined with the child\u2019s cause of action for wrongful life.<\/p>\n<p>In element 1, select the first option if the claim is that the defendant failed to diagnose or warn the plaintiff of a possible genetic impairment. Select the second option if the claim is that the defendant failed to order or advise of available genetic testing. In a testing case, there is no causation unless the chances that the test would disclose the impairment were at least 50 percent. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Simmons v. West Covina Medical Clinic<\/span>\u00a0(1989) 212 Cal.App.3d 696, 702\u2013703 [260 Cal.Rptr. 772].)<\/p>\n<p>In order for this instruction to apply, the genetic impairment must result in a physical or mental disability. This is implied by the fourth element in the instruction. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">No Wrongful Life Claim Against Parent.\u00a0Civil Code section 43.6(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[I]t may be helpful to recognize that although the cause of action at issue has attracted a special name\u2014\u2018wrongful life\u2019\u2014plaintiff\u2019s basic contention is that her action is simply one form of the familiar medical or professional malpractice action. The gist of plaintiff\u2019s claim is that she has suffered harm or damage as a result of defendants\u2019 negligent performance of their professional tasks, and that, as a consequence, she is entitled to recover under generally applicable common law tort principles.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Turpin v. Sortini<\/span>\u00a0(1982) 31 Cal.3d 220, 229 [182 Cal.Rptr. 337, 643 P.2d 954].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cClaims for \u2018wrongful life\u2019 are essentially actions for malpractice based on negligent genetic counseling and testing.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Gami v. Mullikin Medical Center<\/span>\u00a0(1993) 18 Cal.App.4th 870, 883 [22 Cal.Rptr.2d 819].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">General damages are not available: \u201c[W]e conclude that while a plaintiff-child in a wrongful life action may not recover general damages for being born impaired as opposed to not being born at all, the child\u2014like his or her parents\u2014may recover special damages for the extraordinary expenses necessary to treat the hereditary ailment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Turpin, supra,<\/span>\u00a031 Cal.3d at p. 239.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">A child may not recover for loss of earning capacity in a wrongful-life action. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Andalon v. Superior Court<\/span>\u00a0(1984) 162 Cal.App.3d 600, 614 [208 Cal.Rptr. 899].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">The negligent failure to administer a test that had only a 20 percent chance of detecting Down syndrome did not establish a reasonably probable causal connection to the birth of a child with this genetic abnormality. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Simmons, supra<\/span>,\u00a0212 Cal.App.3d at pp. 702\u2013703)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWrongful life claims are actions brought on behalf of children, while wrongful birth claims refer to actions brought by parents. California courts do recognize a wrongful life claim by an \u2018impaired\u2019 child for special damages (but not for general damages), when the physician\u2019s negligence is the proximate cause of the child\u2019s need for extraordinary medical care and training. No court, however, has expanded tort liability to include wrongful life claims by children born without any mental or physical impairment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Alexandria S. v. Pac.
