To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] performed a medical procedure without [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s consent; [or]]<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] consented to one medical procedure, but [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] performed a substantially different medical procedure;]<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm.<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">A patient can consent to a medical procedure by words or conduct. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Derived from former CACI No. 530 April 2007; Revised October 2008 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>Select either or both of the two bracketed options in the first element depending on the nature of the case. In a case of a conditional consent in which it is alleged that the defendant proceeded without the condition having occurred, give\u00a0CACI No. 530B,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Medical Battery\u2014Conditional Consent<\/span>. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe California Supreme Court has described the right to consent to medical treatment as \u2018\u2009\u201cbasic and fundamental,\u201d\u2009\u2019 \u2018intensely individual,\u2019 and \u2018broadly based.\u2019 The same court has also emphasized that excusing the patient from a judicial proceeding regarding a surgery to be performed over his objection \u2018denie[s] fundamental due process.\u2019 It is immaterial that a doctor has said the treatment is required to save the patient\u2019s life. Rather, \u2018\u2009\u201cA doctor might well believe that an operation or form of treatment is desirable or necessary, but the law does not permit him to substitute his own judgment for that of the patient by any form of artifice or deception.\u201d\u2009\u2019 Finally, the patient\u2019s reasons for refusing are irrelevant. \u2018For self-determination to have any meaning, it cannot be subject to the scrutiny of anyone else\u2019s conscience or sensibilities.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Stewart v. Superior Court<\/span>\u00a0(2017) 16 Cal.App.5th 87, 105 [224 Cal.Rptr.3d 219], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Battery may also be found if a substantially different procedure is performed: \u201cWhere a doctor obtains consent of the patient to perform one type of treatment and subsequently performs a substantially different treatment for which consent was not obtained, there is a clear case of battery.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cobbs v. Grant<\/span>\u00a0(1972) 8 Cal.3d 229, 239 [104 Cal.Rptr. 505, 502 P.2d 1].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe battery theory should be reserved for those circumstances when a doctor performs an operation to which the patient has not consented. When the patient gives permission to perform one type of treatment and the doctor performs another, the requisite element of deliberate intent to deviate from the consent given is present. However, when the patient consents to certain treatment and the doctor performs that treatment but an undisclosed inherent complication with a low probability occurs, no intentional deviation from the consent given appears; rather, the doctor in obtaining consent may have failed to meet his due care duty to disclose pertinent information. In that situation the action should be pleaded in negligence.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cobbs, supra,<\/span>\u00a08 Cal.3d at p. 240.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cOur high court has made it clear that battery and lack of informed consent are separate causes of action. A claim based on lack of informed consent\u2014which sounds in negligence\u2014arises when the doctor performs a procedure without first adequately disclosing the risks and alternatives. In contrast, a battery is an intentional tort that occurs when a doctor performs a procedure without obtaining any consent.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Saxena v. Goffney<\/span>\u00a0(2008) 159 Cal.App.4th 316, 324 [71 Cal.Rptr.3d 469].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cConfusion may arise in the area of \u2018exceeding a patient\u2019s consent.\u2019 In cases where a doctor exceeds the consent and such excess surgery is found necessary due to conditions arising during an operation which endanger the patient\u2019s health or life, the consent is presumed. The surgery necessitated is proper (though exceeding specific consent) on the theory of assumed consent, were the patient made aware of the additional need.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pedesky v. Bleiberg<\/span>\u00a0(1967) 251 Cal.App.2d 119, 123 [59 Cal.Rptr. 294].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cConsent to medical care, including surgery, may be express or may be implied from the circumstances.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bradford v. Winter<\/span>\u00a0(1963) 215 Cal.App.2d 448, 454 [30 Cal.Rptr. 243].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIt is elemental that consent may be manifested by acts or conduct and need not necessarily be shown by a writing or by express words.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Kritzer v. Citron<\/span>\u00a0(1950) 101 Cal.App.2d 33, 38\u201339 [224 P.2d 808].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[T]he reason why\u00a0CACI No. 530B\u00a0has an explicit intent and knowledge requirement and\u00a0CACI No. 530A\u00a0does not is clear. The law presumes that \u2018[w]hen the patient gives permission to perform one type of treatment and the doctor performs another, the requisite element of deliberate intent to deviate from the consent given is present.\u2019 That situation is covered by\u00a0CACI No. 530A.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Dennis v. Southard<\/span>\u00a0(2009) 174 Cal.App.4th 540, 544 [94 Cal.Rptr.3d 559], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn the absence of any definitive case law establishing whether operating on the wrong disk within inches of the correct disk is a \u2018substantially different procedure,\u2019 we conclude the matter is a factual question for a finder of fact to decide and at least in this instance, not one capable of being decided on demurrer.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Kaplan v. Mamelak<\/span>\u00a0(2008) 162 Cal.App.4th 637, 647 [75 Cal.Rptr.3d 861.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAlthough \u2026 consent to surgery necessarily encompasses consent to postoperative care, not all postoperative\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">contact<\/span>\u00a0between doctor and patient constitutes\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">care<\/span>. The question of the nature of the contact between plaintiff and [defendant], and whether that contact was within the scope of plaintiff\u2019s consent, is a factual question for a finder of fact to decide.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">So v.
