class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] claims that [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not have to obtain [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient\/authorized person<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s informed consent to the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert medical procedure<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] because an emergency existed. To succeed, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] reasonably believed the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert medical procedure<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] had to be done immediately in order to preserve the life or health of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert one or more of the following:<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was unconscious] [or]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[there was not enough time to inform [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of patient<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]] [or]<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[there was not enough time to get consent from an authorized person]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>\u201cWhenever appropriate, the court should instruct the jury on the defenses available to a doctor who has failed to make the disclosure required by law.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cobbs v. Grant<\/span>\u00a0(1972) 8 Cal.3d 229, 245 [104 Cal.Rptr. 505, 502 P.2d 1].) This instruction could be modified to cover \u201cinformed refusal\u201d cases by redrafting it to state, in substance, that the emergency situation made it impossible to inform the patient regarding the risks of refusing the test. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">When Consent Not Required.\u00a0Business and Professions Code sections 2397(a)\u00a0(doctor), 1627.7(a) (dentist).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Consent is implied in an emergency situation. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cobbs, supra,<\/span>\u00a08 Cal.3d at p. 243.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">This defense is considered a \u201cjustification.\u201d Justification for failure to disclose is an affirmative defense on which the defendant has the burden of proof. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mathis v. Morrissey<\/span>\u00a0(1992) 11 Cal.App.4th 332, 347, fn. 9 [13 Cal.Rptr.2d 819].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">The existence of an emergency situation can also be a defense to battery. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Wheeler v. Barker<\/span>\u00a0(1949) 92 Cal.App.2d 776, 781 [208 P.2d 68];\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Preston v. Hubbell<\/span>\u00a0(1948) 87 Cal.App.2d 53, 57\u201358 [196 P.2d 113];\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Hundley v.
