Grant<\/span>\u00a0(1972) 8 Cal.3d 229, 245 [104 Cal.Rptr. 505, 502 P.2d 1].) This instruction could be modified to cover \u201cinformed refusal\u201d cases by redrafting it to state, in substance, that the information regarding the risks of refusing the test would have seriously upset the patient. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cA disclosure need not be made beyond that required within the medical community when a doctor can prove by a preponderance of the evidence he relied upon facts which would demonstrate to a reasonable man the disclosure would have so seriously upset the patient that the patient would not have been able to dispassionately weigh the risks of refusing to undergo the recommended treatment.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Cobbs, supra,<\/span>\u00a08 Cal.3d at p. 246.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">This defense is considered a \u201cjustification.\u201d Justification for failure to disclose is an affirmative defense on which the defendant has the burden of proof. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mathis v.
