Code, \u00a7\u00a7\u200923152, 23153)<\/h2>\n<hr \/>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">The statute just read to you uses the term \u201cunder the influence.\u201d A driver is not necessarily \u201cunder the influence\u201d just because the driver has consumed some alcohol [or drugs]. A driver is \u201cunder the influence\u201d when the driver has consumed an amount of alcohol [or drugs] that impairs the driver\u2019s ability to drive in a reasonably careful manner. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised May 2020 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>This instruction is designed to supplement a negligence per se instruction on driving under the influence.<\/p>\n<p>The presumption of intoxication based on a 0.08 blood level applies to criminal prosecutions only. There is no statutory or case authority supporting the conclusion that the presumption applies in civil cases. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Hyatt v. Sierra Boat Co.<\/span>\u00a0(1978) 79 Cal.App.3d 325, 334 [145 Cal.Rptr. 47].)<\/p>\n<p>For a definition of \u201cdrug,\u201d see\u00a0Vehicle Code section 312: \u201cThe term \u2018drug\u2019 means any substance or combination of substances, other than alcohol, which could so affect the nervous system, brain, or muscles of a person as to impair, to an appreciable degree, his ability to drive a vehicle in the manner that an ordinarily prudent and cautious man, in full possession of his faculties, using reasonable care, would drive a similar vehicle under like conditions.\u201d <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Driving Under the Influence of Alcohol or Drugs.\u00a0Vehicle Code sections 23152(a),\u00a023153(a).<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cAll of the decided cases on the subject recognize that it is negligence as a matter of law to drive a vehicle upon a public highway while in an intoxicated condition<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">.<\/span>\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Zamucen v. Crocker<\/span>\u00a0(1957) 149 Cal.App.2d 312, 316 [308 P.2d 384], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">The term \u201cunder the influence\u201d was first defined in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People v. Dingle<\/span>\u00a0(1922) 56 Cal.App. 445, 449 [205 P. 705], as follows: \u201c[I]f intoxicating liquor has so far affected the nervous system, brain, or muscles of the driver of an automobile as to impair, to an appreciable degree, his ability to operate his car in the manner that an ordinarily prudent and cautious man, in the full possession of his faculties, using reasonable care, would operate or drive a similar vehicle under like conditions, then such driver is \u2018under the influence of intoxicating liquor\u2019 within the meaning of the statute.\u201d<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cOne is not necessarily under the influence of intoxicating liquor as the result of taking one or more drinks. The circumstances and effect must be considered; whether or not a person was under the influence of intoxicating liquor at a certain time is a question of fact for the jury to decide.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Pittman v. Boiven<\/span>\u00a0(1967) 249 Cal.App.2d 207, 217 [57 Cal.Rptr. 319].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Driving while \u201cunder the influence\u201d under\u00a0Vehicle Code sections 23152\u00a0and\u00a023153\u00a0is not the same as \u201cbeing under the influence\u201d of a controlled substance under\u00a0Health and Safety Code section 11550. Under the Vehicle Code provisions, \u201cthe defendant\u2019s ability to drive must actually be impaired,\u201d while the Health and Safety Code provision is violated as soon as the influence is present \u201cin any detectable manner.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">People v. Enriquez<\/span>\u00a0(1996) 42 Cal.App.4th 661, 665 [49 Cal.Rptr.2d 710].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Courts have also distinguished the \u201cunder the influence\u201d standard from the \u201cobvious intoxication\u201d standard used in\u00a0Business and Professions Code section 25602.1. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Jones v.
