class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed by the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] that was sold by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] because the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was not fit for human consumption. To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [ate\/drank] a [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] sold by [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That, at the time of purchase, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was in the business of selling the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [or by [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] occupation held [himself\/herself\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/itself] out as having special knowledge or skill regarding this [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmful when consumed;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the harmful condition would not reasonably be expected by the average consumer;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">6.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">food product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>If an instruction on the giving of notice to the seller is needed, see\u00a0CACI No.\u20021243,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Notification\/Reasonable Time<\/span>.<\/p>\n<p>The advisory committee believes that the judge, not the jury, would decide whether the food substance is natural or foreign under\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mexicali Rose v. Superior Court<\/span>\u00a0(1992) 1 Cal.4th 617 [4 Cal.Rptr.2d 145, 822 P.2d 1292]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn the peculiar context of foodstuffs, the theory of breach of an implied warranty of merchantability has closer affinities to tort law than to contract law because it allows recovery of damages, without regard to privity of contract, for personal injuries as well as economic loss.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Shade Foods, Inc. v. Innovative Products Sales &amp; Marketing, Inc.<\/span>\u00a0(2000) 78 Cal.App.4th 847, 871 [93 Cal.Rptr.2d 364], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIf the injury-producing substance is natural to the preparation of the food served, it can be said that it was reasonably expected by its very nature and the food cannot be determined unfit or defective. A plaintiff in such a case has no cause of action in strict liability or implied warranty. If, however, the presence of the natural substance is due to a restaurateur\u2019s failure to exercise due care in food preparation, the injured patron may sue under a negligence theory.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mexicali Rose v. Superior Court<\/span>\u00a0(1992) 1 Cal.4th 617, 633 [4 Cal.Rptr.2d 145, 822 P.2d 1292].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIf the injury-causing substance is foreign to the food served, then the injured patron may also state a cause of action in implied warranty and strict liability, and the trier of fact will determine whether the substance (i) could be reasonably expected by the average consumer and (ii) rendered the food unfit or defective.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mexicali Rose, supra,<\/span>\u00a01 Cal.4th at p. 633.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">The\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mexicali Rose<\/span>\u00a0decision was limited to commercial restaurant establishments. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mexicali Rose, supra,<\/span>\u00a01 Cal.4th at p. 619, fn. 1.) However, the reasoning of that case has been applied to supermarkets. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Ford v. Miller Meat Co.<\/span>\u00a0(1994) 28 Cal.App.4th 1196 [33 Cal.Rptr.2d 899].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe term \u2018natural\u2019 refers to bones and other substances natural to the product served, and does not encompass substances such as mold, botulinus bacteria or other substances (like rat flesh or cow eyes) not natural to the\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">preparation<\/span>\u00a0of the product served.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Mexicali Rose, supra,<\/span>\u00a01 Cal.4th at p. 631, fn. 5.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">It appears that the court would decide as a matter of law if the injury-producing substance is \u201cnatural\u201d or not: \u201cIf the injury-producing substance is natural to the preparation of the food served, it can be said that it was reasonably expected by its very nature and the food cannot be determined unfit or defective.
