data-housestyle=\"EMPHASIS_bf\">] claims that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was negligent because [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/it] failed to [recall\/retrofit] the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]. To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] [manufactured\/distributed\/sold] the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] knew or reasonably should have known that the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was dangerous or was likely to be dangerous when used in a reasonably foreseeable manner;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] became aware of this defect after the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was sold;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] failed to [recall\/retrofit] [or warn of the danger of] the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That a reasonable [manufacturer\/distributor\/seller] under the same or similar circumstances would have [recalled\/retrofitted] the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">6.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was harmed; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">7.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s failure to [recall\/retrofit] the [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">product<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s harm. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Badger Construction Equipment Co.<\/span>\u00a0(1994) 28 Cal.App.4th 1791, 1827 [34 Cal.Rptr.2d 732], internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">In\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Lunghi v. Clark Equipment Co<\/span>. (1984) 153 Cal.App.3d 485 [200 Cal.Rptr. 387], the court observed that, where the evidence showed that the manufacturer became aware of dangers after the product had been on the market, the jury \u201ccould still have found that Clark\u2019s knowledge of the injuries caused by these features imposed a\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">duty to warn<\/span>\u00a0of the danger, and\/or a\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">duty to conduct an adequate retrofit campaign<\/span>.\u201d The failure to meet the standard of reasonable care with regard to either of these duties could have supported a finding of negligence. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Id.<\/span>\u00a0at p. 494, original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">In\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Balido v. Improved Machinery, Inc.<\/span>\u00a0(1972) 29 Cal.App.3d 633 [105 Cal.Rptr. 890]\u00a0(disapproved on other grounds in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Regents of University of California v. Hartford Accident &amp; Indemnity Co.<\/span>\u00a0(1978) 21 Cal.3d 624, 641\u2013642 [147 Cal.Rptr. 486, 581 P.2d 197]), the court concluded that a jury could reasonably have found negligence based upon the manufacturer\u2019s failure to retrofit equipment determined to be unsafe after it was sold, even though the manufacturer told the equipment\u2019s owners of the safety problems and offered to correct those problems for $500. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Id<\/span>. at p. 649.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">If a customer fails to comply with a recall notice, this will not automatically absolve the manufacturer from liability: \u201cA manufacturer cannot delegate responsibility for the safety of its product to dealers, much less purchasers.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Springmeyer v.
