To succeed, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove both of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] reasonably believed that [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was going to harm [him\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert identification of other person<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] used only the amount of force that was reasonably necessary to protect [himself\/herself\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert identification of other person<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]]. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003; Revised June 2014 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_2\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">Self Defense.\u00a0Civil Code section 50.<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cWhen an alleged act of self-defense \u2026 is at issue, the question of what force was reasonable and justified is\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">peculiarly one for determination by the trier of fact<\/span>.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Burton v. Sanner<\/span>\u00a0(2012) 207 Cal.App.4th 12, 14 [142 Cal.Rptr.3d 782], original italics.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSelf-defense being an affirmative defense, it must, in a civil action, be established by the defendant by a preponderance of the evidence.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Bartosh v. Banning<\/span>\u00a0(1967) 251 Cal.App.2d 378, 386 [59 Cal.Rptr. 382].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn a suit for assault and battery, the defendant is not liable if that defendant reasonably believed, in view of all the circumstances of the case, that the plaintiff was going to harm him or her and the defendant used only the amount of force reasonably necessary to protect himself or herself.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">J.J. v. M.F.<\/span>\u00a0(2014) 223 Cal.App.4th 968, 976 [167 Cal.Rptr.3d 670]\u00a0[citing this instruction].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe right to use force against another has long been limited by the condition that the force be no more than \u2018\u2009\u201cthat which reasonably appears necessary, in view of all the circumstances of the case, to prevent the impending injury.\u201d \u2018When the amount of force used is justifiable under the circumstances, it is not willful and the actor may escape liability for intentionally injurious conduct that is otherwise actionable. But if force is applied in excess of that which is justified, the actor remains subject to liability for the damages resulting from the excessive use of force.\u2009\u2026 When an alleged act of self-defense or defense of property is at issue, the question of what force was reasonable and justified is peculiarly one for determination by the trier of fact.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Calvillo-Silva v. Home Grocery<\/span>\u00a0(1998) 19 Cal.4th 714, 730\u2013731 [80 Cal.Rptr.2d 506, 968 P.2d 65], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe right of self-defense is not limited by actualities. The correct rule \u2026 [is]: \u2018Generally \u2026\u2009, the force that one may use in self-defense is that which reasonably appears necessary, in view of all the circumstances of the case, to prevent the impending injury.\u2019 In emphasizing that the law of self-defense is a law of necessity courts should never lose sight of the fact that the necessity may be either real or apparent.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Vaughn v.
