a client, an attorney is entitled to rely on the facts and information provided by the client.<\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Name of attorney defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] claims that [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] had reasonable grounds for bringing the lawsuit against [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] because [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] was relying on facts and information provided by [his\/her\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] client. To succeed on this defense, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of attorney defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of client<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] provided [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of attorney defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] with the following information: [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">specify information on which attorney relied<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of attorney defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] did not know that this information was false or inaccurate; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of attorney defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] relied on the facts and information provided by the client. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New June 2013; Revised June 2014, May 2020 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>Give this instruction if an attorney defendant alleges reliance on information provided by the client to establish probable cause. If a civil proceeding other than a lawsuit is involved, substitute the appropriate word for \u201clawsuit\u201d throughout.<\/p>\n<p>The presence or absence of probable cause on undisputed facts is a question of law for the court. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Sheldon Appel Co. v. Albert &amp; Oliker<\/span>\u00a0(1989) 47 Cal.3d 863, 881 [254 Cal.Rptr. 336, 765 P.2d 498];\u00a0CACI No. 1501,\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Wrongful Use of Civil Proceedings<\/span>.) The questions here for the jury to resolve are what information was communicated to the attorney that established apparent probable cause, and whether the attorney knew that the information was inaccurate.<\/p>\n<p>The attorney generally has no obligation to investigate the information provided by the client before filing suit. (See\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Sheldon Appel Co., supra<\/span>, 47 Cal.3d at pp. 882\u2013883.) Therefore, there is no liability under a theory that the attorney should have known that the information was false. Actual knowledge is required. But if the attorney later learns that the client has not been truthful, the attorney may no longer rely on the client\u2019s information to continue the lawsuit. (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Daniels v. Robbins<\/span>\u00a0(2010) 182 Cal.App.4th 204, 223 [105 Cal.Rptr.3d 683].) <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cIn general, a lawyer \u2018is entitled to rely on information provided by the client.\u2019 If the lawyer discovers the client\u2019s statements are false, the lawyer cannot rely on such statements in prosecuting an action.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Daniels, supra<\/span>, 182 Cal.App.4th at p. 223, internal citation omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[W]hen evaluating a client\u2019s case and making an initial assessment of tenability, the attorney is entitled to rely on information provided by the client. An exception to this rule exists where the attorney is on notice of specific factual mistakes in the client\u2019s version of events. Absent such notice, an attorney \u2018may, without being guilty of malicious prosecution, vigorously pursue litigation in which he is unsure of whether his client or the client\u2019s adversary is truthful, so long as that issue is genuinely in doubt.\u2019 A respected authority has summed up the issue as follows: \u2018Usually, the client imparts information upon which the attorney relies in determining whether probable cause exists for initiating a proceeding. The rule is that the attorney may rely on those statements as a basis for exercising judgment and providing advice, unless the client\u2019s representations are known to be false.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Morrison v. Rudolph<\/span>\u00a0(2002) 103 Cal.App.4th 506, 512\u2013513 [126 Cal.Rprt.2d 747], disapproved on other grounds in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Zamos v. Stroud<\/span>\u00a0(2004) 32 Cal.4th 958, 972[12 Cal.Rptr.3d 54, 87 P.3d 802], internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe trial court found the undisputed facts establish that the lawyers had probable cause to assert the fraudulent inducement claim. We agree. It is undisputed that the allegations in the complaint accurately reflected the facts as given to the lawyers by [client] and that she never told them those facts were incorrect. The information provided to the lawyers, if true, was sufficient to state a cause of action\u2009\u2026\u2009.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Swat-Fame, Inc. v.
