data-housestyle=\"EMPHASIS_bf\">] to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert applicable carcinogen, toxic substance, HIV, or AIDS<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]. To establish this claim, [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] must prove all of the following:<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">1.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct was outrageous;<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">2.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct exposed [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] to [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert applicable carcinogen, toxic substance, HIV, or AIDS<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">];<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">3.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] intended to cause [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] emotional distress;] [or]<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">[That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] acted with reckless disregard of the probability that [[<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\/the group of individuals including [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]] would suffer emotional distress, knowing that [he\/she\/<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">nonbinary pronoun<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">\/they] [was\/were] present when the conduct occurred;]<\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">4.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] suffered severe emotional distress from a reasonable fear of developing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert applicable cancer, HIV, or AIDS<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]; and<\/span><\/span><\/p>\n<p><span class=\"SS_ListLabel\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">5.<\/span><\/span><span class=\"SS_ListItemContent\"><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">That [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of defendant<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s conduct was a substantial factor in causing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">name of plaintiff<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">]\u2019s severe emotional distress.<\/span><\/span><\/p>\n<p><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">A fear of developing [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert applicable cancer, HIV, or AIDS<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] is \u201creasonable\u201d if the fear stems from the knowledge, confirmed by reliable medical or scientific opinion, that a person\u2019s risk of [<\/span><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">insert applicable cancer, HIV, or AIDS<\/span><span class=\"SS_bf\" data-housestyle=\"EMPHASIS_bf\">] has significantly increased and that the resulting risk is significant. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\"><\/h2>\n<div id=\"TRNotes_n_1\">\n<p><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">New September 2003 <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">Crowdsource Lawyers<\/a><\/p>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci\">https:\/\/crowdsourcelawyers.com\/judicial-council-california-civil-jury-instructions-caci<\/a><span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\"><br class=\"avia-permanent-lb\" \/><\/span><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Directions for Use<\/h2>\n<div id=\"TRNotes_n_2\">\n<p>CACI Nos.\u20021602\u20131604, regarding the elements of intentional infliction of emotional distress, should be given with the above instruction. Depending on the facts of the case, a plaintiff could choose one or both of the bracketed choices in element 3.<\/p>\n<p>There may be other harmful agents and medical conditions that could support this cause of action.<\/p>\n<p>See\u00a0CACI Nos.\u20021622\u00a0and\u00a01623\u00a0for claims of negligent infliction of emotional distress involving fear of cancer, HIV, or AIDS. <br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<\/div>\n<\/div>\n<div class=\"SS_Note\">\n<h2 class=\"SS_HideShowSection SS_Expandable\">Sources and Authority<\/h2>\n<div id=\"TRNotes_n_3\">\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cThe elements of the tort of intentional infliction of emotional distress are: \u2018(1) extreme and outrageous conduct by the defendant with the intention of causing, or reckless disregard of the probability of causing, emotional distress; (2) the plaintiff\u2019s suffering severe or extreme emotional distress; and (3) actual and proximate causation of the emotional distress by the defendant\u2019s outrageous conduct.\u2019\u2009\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Christensen v. Superior Court<\/span>\u00a0(1991) 54 Cal.3d 868, 903 [2 Cal.Rptr.2d 79, 820 P.2d 181], internal citation omitted;\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Potter v. Firestone Tire and Rubber Co.<\/span>\u00a0(1993) 6 Cal.4th 965, 1001 [25 Cal.Rptr.2d 550, 863 P.2d 795].)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c\u2009\u2018The law limits claims of intentional infliction of emotional distress to egregious conduct toward plaintiff proximately caused by defendant.\u2019 The only exception to this rule is that recognized when the defendant is aware of, but acts with reckless disregard of, the plaintiff and the probability that his or her conduct will cause severe emotional distress to that plaintiff. Where reckless disregard of the plaintiff\u2019s interests is the theory of recovery, the presence of the plaintiff at the time the outrageous conduct occurs is recognized as the element establishing a higher degree of culpability which, in turn, justifies recovery of greater damages by a broader group of plaintiffs than allowed on a negligent infliction of emotional distress theory.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Christensen, supra<\/span>, 54 Cal.3d at pp. 905\u2013906, internal citations omitted.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201cSevere emotional distress [is] emotional distress of such substantial quantity or enduring quality that no reasonable [person] in a civilized society should be expected to endure it.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Fletcher v. Western Life Insurance Co<\/span>. (1970) 10 Cal.App.3d 376, 397 [89 Cal.Rptr. 78];\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Potter, supra,<\/span>\u00a06 Cal.4th at p. 1004.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">\u201c[I]t must \u2026 be established that plaintiff\u2019s fear of cancer is reasonable, that is, that the fear is based upon medically or scientifically corroborated knowledge that the defendant\u2019s conduct has significantly increased the plaintiff\u2019s risk of cancer and that the plaintiff\u2019s actual risk of the threatened cancer is significant.\u201d (<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Potter, supra,<\/span>\u00a06 Cal.4th at p. 1004.)<\/span><\/p>\n<p><span class=\"SS_ListLabel\">\u2022<\/span><span class=\"SS_ListItemContent\">The court in\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Herbert v. Regents of University of California<\/span>\u00a0(1994) 26 Cal.App.4th 782, 787\u2013788 [31 Cal.Rptr.2d 709]\u00a0held that the rules relating to recovery of damages for fear of cancer apply to fear of AIDS. See also\u00a0<span class=\"SS_it\" data-housestyle=\"EMPHASIS_it\">Kerins v.
