Harassment by Persons in Certain Facilities; \u2009Harassment of Public Servant<\/h2>\n<p>(a)\u2002A person commits an offense if, with the intent to assault, harass, or alarm, the person:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002while imprisoned or confined in a correctional or detention facility, causes another person to contact the blood, seminal fluid, vaginal fluid, saliva, urine, or feces of the actor, any other person, or an animal;<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002while committed to a civil commitment facility, causes:<\/p>\n<p style=\"padding-left: 80px\">(A)\u2002an officer or employee of the Texas Civil Commitment Office to contact the blood, seminal fluid, vaginal fluid, saliva, urine, or feces of the actor, any other person, or an animal:<\/p>\n<p style=\"padding-left: 120px\">(i)\u2002while the officer or employee is lawfully discharging an official duty at a civil commitment facility; \u2009or<\/p>\n<p style=\"padding-left: 120px\">(ii)\u2002in retaliation for or on account of an exercise of official power or performance of an official duty by the officer or employee; \u2009or<\/p>\n<p style=\"padding-left: 80px\">(B)\u2002a person who contracts with the state to perform a service in the facility or an employee of that person to contact the blood, seminal fluid, vaginal fluid, saliva, urine, or feces of the actor, any other person, or an animal:<\/p>\n<p style=\"padding-left: 120px\">(i)\u2002while the person or employee is engaged in performing a service within the scope of the contract, if the actor knows the person or employee is authorized by the state to provide the service; \u2009or<\/p>\n<p style=\"padding-left: 120px\">(ii)\u2002in retaliation for or on account of the person&#8217;s or employee&#8217;s performance of a service within the scope of the contract; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(3)\u2002causes another person the actor knows to be a public servant to contact the blood, seminal fluid, vaginal fluid, saliva, urine, or feces of the actor, any other person, or an animal while the public servant is lawfully discharging an official duty or in retaliation or on account of an exercise of the public servant&#8217;s official power or performance of an official duty.<\/p>\n<p>(b)\u2002An offense under this section is a felony of the third degree.<\/p>\n<p>(c)\u2002If conduct constituting an offense under this section also constitutes an offense under another section of this code, the actor may be prosecuted under either section.<\/p>\n<p>(d)\u2002In this section, \u201ccorrectional or detention facility\u201d means:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002a secure correctional facility; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002a \u201csecure correctional facility\u201d or a \u201csecure detention facility\u201d as defined by Section 51.02, Family Code , operated by or under contract with a juvenile board or the Texas Juvenile Justice Department or any other facility operated by or under contract with that department.<\/p>\n<p>(e)\u2002For purposes of Subsection (a)(3), the actor is presumed to have known the person was a public servant if the person was wearing a distinctive uniform or badge indicating the person&#8217;s employment as a public servant.<\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-174","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.0 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Texas Penal Code 22.11 Harassment by Persons in Certain Facilities;
