Abuse of Corpse<\/h2>\n<p>(a)\u2002A person commits an offense if the person, without legal authority, knowingly:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002disinters, disturbs, damages, dissects, in whole or in part, carries away, or treats in an offensive manner a human corpse;<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002conceals a human corpse knowing it to be illegally disinterred;<\/p>\n<p style=\"padding-left: 40px\">(3)\u2002sells or buys a human corpse or in any way traffics in a human corpse;<\/p>\n<p style=\"padding-left: 40px\">(4)\u2002transmits or conveys, or procures to be transmitted or conveyed, a human corpse to a place outside the state; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(5)\u2002vandalizes, damages, or treats in an offensive manner the space in which a human corpse has been interred or otherwise permanently laid to rest.<\/p>\n<p>(b)\u2002An offense under this section is a state jail felony, except that an offense under Subsection (a)(5) is a Class A misdemeanor.<\/p>\n<p>(c)\u2002In this section, \u201chuman corpse\u201d includes:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002any portion of a human corpse;<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002the cremated remains of a human corpse; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(3)\u2002any portion of the cremated remains of a human corpse.<\/p>\n<p>(d)\u2002If conduct constituting an offense under this section also constitutes an offense under another section of this code, the actor may be prosecuted under either section or both sections.<\/p>\n<p>(e)\u2002It is a defense to prosecution under this section that the actor:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002as a member or agent of a cemetery organization, removed or damaged anything that had been placed in or on any portion of the organization&#8217;s cemetery in violation of the rules of the organization; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002removed anything:<\/p>\n<p style=\"padding-left: 80px\">(A)\u2002placed in the cemetery in violation of the rules of the cemetery organization; \u2009or<\/p>\n<p style=\"padding-left: 80px\">(B)\u2002placed in the cemetery by or with the cemetery organization&#8217;s consent but that, in the organization&#8217;s judgment, had become wrecked, unsightly, or dilapidated.<\/p>\n<p>(f)\u2002In this section, \u201ccemetery\u201d and \u201ccemetery organization\u201d have the meanings assigned by Section 711.001, Health and Safety Code .<\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-242","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
