Terroristic Threat<\/h2>\n<div class=\"subsection\">\n<p>(a)\u2002A person commits an offense if he threatens to commit any offense involving violence to any person or property with intent to:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002cause a reaction of any type to his threat by an official or volunteer agency organized to deal with emergencies;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002place any person in fear of imminent serious bodily injury;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002prevent or interrupt the occupation or use of a building, room, place of assembly, place to which the public has access, place of employment or occupation, aircraft, automobile, or other form of conveyance, or other public place;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(4)\u2002cause impairment or interruption of public communications, public transportation, public water, gas, or power supply or other public service;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(5)\u2002place the public or a substantial group of the public in fear of serious bodily injury; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(6)\u2002influence the conduct or activities of a branch or agency of the federal government, the state, or a political subdivision of the state.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002An offense under Subsection (a)(1) is a Class B misdemeanor.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002An offense under Subsection (a)(2) is a Class B misdemeanor, except that the offense is a Class A misdemeanor if the offense:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002is committed against a member of the person&#8217;s family or household or otherwise constitutes family violence; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002is committed against a public servant.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(c-1)\u2002Notwithstanding Subsection (c)(2), an offense under Subsection (a)(2) is a state jail felony if the offense is committed against a person the actor knows is a peace officer or judge.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002An offense under Subsection (a)(3) is a Class A misdemeanor, unless the actor causes pecuniary loss of $1,500 or more to the owner of the building, room, place, or conveyance, in which event the offense is a state jail felony.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002An offense under Subsection (a)(4), (a)(5), or (a)(6) is a felony of the third degree.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002In this section:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002\u201cFamily\u201d has the meaning assigned by\u00a0<span class=\"cite\">Section 71.003, Family Code\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002\u201cFamily violence\u201d has the meaning assigned by\u00a0<span class=\"cite\">Section 71.004, Family Code\u00a0<\/span>.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002\u201cHousehold\u201d has the meaning assigned by\u00a0<span class=\"cite\">Section 71.005, Family Code\u00a0<\/span>.<\/p>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(g)\u2002For purposes of Subsection (d), the amount of pecuniary loss is the amount of economic loss suffered by the owner of the building, room, place, or conveyance as a result of the prevention or interruption of the occupation or use of the building, room, place, or conveyance.<\/p>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-32","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
