Delayed Registration of Death<\/h2>\n<div class=\"subsection\">\n<p>(a)\u2002A death that occurred more than 10 days but less than one year before the date of an application for registration of death may be recorded on a death certificate and submitted for filing with the local registrar of the registration district in which the death occurred.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002To file a record of a death that occurred in this state but was not registered within one year of the date of death, a person shall submit a record of the death to the county probate court in the county in which the death occurred.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002The department shall furnish a form for filing records under this section. \u2002Records submitted under this section must be on the form furnished by the department. \u2002The state registrar may accept a certificate that is verified as provided by this section.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002The certificate must be supported by the affidavit of:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002the physician last in attendance on the decedent or the funeral director who buried the body; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002if the affidavit of the physician or funeral director cannot be obtained:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(A)\u2002any person who was acquainted with the facts surrounding the death when the death occurred; \u2009and<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(B)\u2002another person who was acquainted with the facts surrounding the death but who is not related to the decedent by consanguinity or affinity, as determined under Chapter 573, Government Code.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(e)\u2002For each application under this section, the court shall collect a $1 fee. \u2002The court retains 50 cents of the fee and the remaining 50 cents is allocated to the clerk of the court for recording the certificate.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(f)\u2002Not later than the seventh day after the date on which a certificate is accepted and ordered filed by a court under this section, the clerk of the court shall forward to the vital statistics unit:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002the certificate; \u2009and<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002an order from the court that the state registrar accept the certificate.<\/p>\n<\/div>\n<\/div>\n<p><br class=\"avia-permanent-lb\" \/><br class=\"avia-permanent-lb\" \/><\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-3755","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
