Unlawful Carrying Weapons<\/h2>\n<div class=\"subsection\">\n<p>(a)\u2002A person commits an offense if the person:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002intentionally, knowingly, or recklessly carries on or about his or her person a handgun\u00a0; \u2009and<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002is not:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(A)\u2002on the person&#8217;s own premises or premises under the person&#8217;s control; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(B)\u2002inside of or directly en route to a motor vehicle or watercraft that is owned by the person or under the person&#8217;s control.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(a-1)\u2002A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun in a motor vehicle or watercraft that is owned by the person or under the person&#8217;s control at any time in which:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002the handgun is in plain view, unless the person is licensed to carry a handgun under Subchapter H, Chapter 411, Government Code, and the handgun is carried in a shoulder or belt holster; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002the person is:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(A)\u2002engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic or boating;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(B)\u2002prohibited by law from possessing a firearm; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(C)\u2002a member of a criminal street gang, as defined by\u00a0<span class=\"cite\">Section 71.01\u00a0<\/span>.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(a-2)\u2002For purposes of this section, \u201c<span class=\"wordphrase\">premises<\/span>\u201d includes real property and a recreational vehicle that is being used as living quarters, regardless of whether that use is temporary or permanent. \u2002In this subsection, \u201c<span class=\"wordphrase\">recreational vehicle<\/span>\u201d means a motor vehicle primarily designed as temporary living quarters or a vehicle that contains temporary living quarters and is designed to be towed by a motor vehicle. \u2002The term includes a travel trailer, camping trailer, truck camper, motor home, and horse trailer with living quarters.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(a-3)\u2002For purposes of this section, \u201c<span class=\"wordphrase\">watercraft<\/span>\u201d means any boat, motorboat, vessel, or personal watercraft, other than a seaplane on water, used or capable of being used for transportation on water.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(a-4)\u2002A person commits an offense if the person:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(1)\u2002intentionally, knowingly, or recklessly carries on or about his or her person a location-restricted knife;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(2)\u2002is younger than 18 years of age at the time of the offense; \u2009and<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 40px\">(3)\u2002is not:<\/p>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(A)\u2002on the person&#8217;s own premises or premises under the person&#8217;s control;<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(B)\u2002inside of or directly en route to a motor vehicle or watercraft that is owned by the person or under the person&#8217;s control; \u2009or<\/p>\n<\/div>\n<div class=\"subsection\">\n<p style=\"padding-left: 80px\">(C)\u2002under the direct supervision of a parent or legal guardian of the person.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"subsection\">\n<p>(b)\u2002Except as provided by Subsection (c) or (d), an offense under this section is a Class A misdemeanor.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(c)\u2002An offense under this section is a felony of the third degree if the offense is committed on any premises licensed or issued a permit by this state for the sale of alcoholic beverages.<\/p>\n<\/div>\n<div class=\"subsection\">\n<p>(d)\u2002An offense under Subsection (a-4) is a Class C misdemeanor.<\/p>\n<\/div>\n<p><br
