Receipt of Remuneration<\/h2>\n<p>(a)\u2002An individual is disqualified for benefits for a benefit period for which the individual is receiving or has received remuneration in the form of:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002wages in lieu of notice;<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002severance pay; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(3)\u2002compensation under a state worker&#8217;s compensation law or a similar law of the United States for:<\/p>\n<p style=\"padding-left: 80px\">(A)\u2002temporary partial disability;<\/p>\n<p style=\"padding-left: 80px\">(B)\u2002temporary total disability; \u2009or<\/p>\n<p style=\"padding-left: 80px\">(C)\u2002total and permanent disability.<\/p>\n<p>(b)\u2002In this section, \u201cseverance pay\u201d means dismissal or separation income paid on termination of employment in addition to the employee&#8217;s usual earnings from the employer at the time of termination. \u2002The term does not include any remuneration received by an employee under:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002a release of claims or settlement agreement entered into between the employee and the employer:<\/p>\n<p style=\"padding-left: 80px\">(A)\u2002based on an alleged violation of the Civil Rights Act of 1991 ( Pub. L. No. 102-166 ); \u20091 \u2009or<\/p>\n<p style=\"padding-left: 80px\">(B)\u2002pursuant to a claim or cause of action filed in connection with the employment relationship; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002a written contract, including a collective bargaining agreement, negotiated with the employer before the date of separation from employment of the employee.<\/p>\n<p>(c)\u2002The commission may adopt rules as necessary to administer this section.<\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-6579","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
