Confirmation of Arrearages<\/h2>\n<p>(a)\u2002If a motion for enforcement of child support requests a money judgment for arrearages, the court shall confirm the amount of arrearages and render one cumulative money judgment.<\/p>\n<p>(b)\u2002A cumulative money judgment includes:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002unpaid child support not previously confirmed;<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002the balance owed on previously confirmed arrearages or lump sum or retroactive support judgments;<\/p>\n<p style=\"padding-left: 40px\">(3)\u2002interest on the arrearages; \u2009and<\/p>\n<p style=\"padding-left: 40px\">(4)\u2002a statement that it is a cumulative judgment.<\/p>\n<p>(b-1)\u2002In rendering a money judgment under this section, the court may not reduce or modify the amount of child support arrearages but, in confirming the amount of arrearages, may allow a counterclaim or offset as provided by this title.<\/p>\n<p>(c)\u2002If the amount of arrearages confirmed by the court reflects a credit to the obligor for support arrearages collected from a federal tax refund under 42 U.S.C. Section 664 , and, subsequently, the amount of that credit is reduced because the refund was adjusted because of an injured spouse claim by a jointly filing spouse, the tax return was amended, the return was audited by the Internal Revenue Service, or for another reason permitted by law, the court shall render a new cumulative judgment to include as arrearages an amount equal to the amount by which the credit was reduced.<\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-883","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
