Misuse of Official Information<\/h2>\n<p>(a)\u2002A public servant commits an offense if, in reliance on information to which the public servant has access by virtue of the person&#8217;s office or employment and that has not been made public, the person:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002acquires or aids another to acquire a pecuniary interest in any property, transaction, or enterprise that may be affected by the information;<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002speculates or aids another to speculate on the basis of the information; \u2009or<\/p>\n<p style=\"padding-left: 40px\">(3)\u2002as a public servant, including as a school administrator, coerces another into suppressing or failing to report that information to a law enforcement agency.<\/p>\n<p>(b)\u2002A public servant commits an offense if with intent to obtain a benefit or with intent to harm or defraud another, he discloses or uses information for a nongovernmental purpose that:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002he has access to by means of his office or employment; \u2009and<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002has not been made public.<\/p>\n<p>(c)\u2002A person commits an offense if, with intent to obtain a benefit or with intent to harm or defraud another, he solicits or receives from a public servant information that:<\/p>\n<p style=\"padding-left: 40px\">(1)\u2002the public servant has access to by means of his office or employment; \u2009and<\/p>\n<p style=\"padding-left: 40px\">(2)\u2002has not been made public.<\/p>\n<p>(d)\u2002In this section, \u201cinformation that has not been made public\u201d means any information to which the public does not generally have access, and that is prohibited from disclosure under Chapter 552, Government Code.<\/p>\n<p>(e)\u2002Except as provided by Subsection (f), an offense under this section is a felony of the third degree.<\/p>\n<p>(f)\u2002An offense under Subsection (a)(3) is a Class C misdemeanor.<\/p>\n<hr \/>\n<p><a href=\"https:\/\/crowdsourcelawyers.com\/\">CrowdSourceLawyers.com<\/a><\/p>\n<\/div><\/section>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":8,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-993","page","type-page","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
